There being no one for or against the matter <br />the public hearing was closed. <br /> <br />Peter Kimball. Planning Commission Representative. stated that the <br />Planning Commission recommended approval of the variance with a 6-0 vote. <br /> <br />cOUNCILMEMBER SCHULDT MOVED TO APROVE THE VARIANCE REQUEST BY PETER <br />BIELEN FOR AN APPROXIMATE 150 FOOT ENCROACHMENT ON THE 200 FOOT FRONTAGE <br />MQUIMMENT LOT IN AN A-l ZONED DISTRICT FOR PROPERTY LOCATED IN THE <br />Sl/20F THE NEl/4. EXCEPT THE THREE ACRES IN THE SW CORNER OF SECTION 26. <br />TOWNSHIP 33, RANGE 26. SHERBURNE COUNTY. MINNESOTA. COUNCILMEMBER <br />HOLMGREN SECONDED THE MOTION. <br /> <br />Councilmember Tralle indicated the reasoning for granting the variance <br />which is because the lot demands special consideration because of the <br />swampy condition of the lot and because County Road 13 comes in at an <br />angle. <br /> <br />THE MOTION CARRIED 4-0. <br /> <br />e <br /> <br />COUNCILMEMBER TRALLE MOVED TO APPROVE THE ADMINISTRATIVE SUBDIVISION <br />TO SPLIT A 17 ACRE PARCEL OF LAND FROM A 77 ACRE PARCEL OF LAND OWNED BY <br />PETER SEELEN AND DESCRIBED AS THE S 1/2 OF TH NE 1/4. EXCEPT THE 3 ACRES <br />IN THE SW CORNER OF SECTION 26. TOWNSHIP 33. RANGE 26. SHERBURNE COUNTY. <br />MN. WITH THE STIPULATION THAT MR. SEELEN PAY $200 IN PARK DEDICATION FEES <br />TO THE CITY AND THAT THE NEW LEGAL DESCRIPTIONS FOR BOTH LOTS BE PROVIDED <br />TO THE CITY FOR RECORDING PURPOSES. COUNCILMEMBER HOLMGREN SECONDED THE <br />MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.5. Zone Change Request by Mr. & Mrs. Joe Kretsch/Public Hearing <br /> <br />Mayor Gunkel indicated that Mr. & Mrs. Joe Kretsch are requesting a zone <br />change for property located on Lots 1 and 2 of Block 15. Village of Elk <br />River Addition from R-3 to a commercial zoning designation. <br /> <br />Planning Commission Representative. Stewart Wilson. indicated that there <br />was public participation at the Planning Commission level and most of it <br />was in favor of the request. He indicated the Planning Commission felt <br />the area was suitable for commercial development and further that the <br />entire corridor should be studied to determine if commercial zoning would <br />be appropriate for the entire area. Mr. Wilson stated that the Planning <br />Commission voted 5-1 in favor of the zone change. <br /> <br />Mayor Gunkel opened the public hearing. <br /> <br />Mr. Craig Willey of 400 Jackson spoke in favor of the zone change. <br /> <br />e <br /> <br />Lola Driessen of 324 Main Street expressed her concern regarding spot <br />zoning and the fact that there is commercial property available in the <br />City without rezoning more commercial property. <br />
