Mayor Gunkel closed the public hearing. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE THE ADMINISTRATIVE SUBDIVISION <br />REQUESTED BY JOHN OLIVER AND K.P. CASWELL JR. TO SPLIT A 11.28 PARCEL OF <br />PROPERTY INTO TWO PARCELS ON PROPERTY LEGALLY DESCRIBED AS: THAT PART OF <br />THE N 1/2 OF THE SW 1/4 IN SECTION 28. AND THAT PART OF THE NE 1/4 OF THE <br />BE 1/4 IN SECTION 29, LYING NORTH OF COUNTY STATE AID HIGHWAY 11 WITH THE <br />FOLLOWING STIPULATIONS: <br /> <br />1. STAFF WILL DETERMINE IF ON-SITE SEPTIC SYSTEM IS ACCEPTABLE AT TIME <br />OF BUILDING PERMIT ISSUANCE. <br /> <br />2. THE LOT SPLIT BE CONTINGENT UPON THE COUNTY'S ACCEPTANCE OF ANOTHER <br />ACCESS ONTO CO. RD. 11 FROM THE ADDITIONAL PARCEL CREATED. ALSO. IF <br />THE COUNTY ACCEPTS THE ADDITIONAL ACCESS ONTO CO. RD. #1. APPROVAL <br />FOR THE LOCATION OF BOTH ACCESSES MUST BE OBTAINED FROM THE COUNTY <br />PRIOR TO BUILDING PERMIT ISSUANCE. <br /> <br />3. THE LOW AREA ON THE WESTERN END OF PARCEL A AND THE LOW AREA ON THE <br />LOT LINE BETWEEN PARCELS A & BBE DESIGNATED AS DRAINAGE EASEMENTS. <br />IF EITHER OF THESES AREAS ARE PROPOSED TO BE FILLED A DRAINAGE PLAN <br />MUST BE APPROVED BY THE CITY ENGINEER. <br /> <br />e <br /> <br />4. <br /> <br />PERK TEST TO BE DONE PRIOR TO BUILDING PERMIT ISSUANCE. NO PARK DEDICATION FEE. <br /> <br />COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.3. & 6.4. Variance and Administrative Subdivision Request by Peter Seelen <br />Public Hearing <br /> <br />Mayor Gunkel indicated that Mr. Peter Seelen of 19459 Tyler Street NW. is <br />requesting an approximate 150 foot encroachment on the 200 foot frontage <br />requirement for a lot in an A-1/Agricultural zoned district. She further <br />indicated that along with this variance. Mr. Seelen is proposing to <br />subdivide his property which consists of approximately 77 acres. into two <br />lots. Mr. Seelen is proposing to split off a 17 acre lot from the 77 <br />acres. The 17 acre lot created in the split has very little building <br />ground. <br /> <br />e <br /> <br />The Building and Zoning Administrator indicated that Mr. Seelen does meet <br />the five standards required for a variance to be granted because his <br />property is split by the County ditch and is in a low swampy area. He <br />further indicated that his driveway would be approximately 1/2 mile long <br />and would go through unsuitable terrain. if he were not granted a <br />variance. <br />
