Elk River, Mn 55330 City of Elk River 13065 Orono Parkway Elk River, Mn 55330 March 21, 2005 Dear City of Elk River: Several E-mail, letters, and phone calls, have been made to Councilman Dietz, and other City officials, dating baclc to March 2003, with claims of recent, violent, train-track vibration damage to Mr. Boop's personal property. The damage to Mr. Boop's home has been extensive, and continues to rapidly deteriorate, as the vibration nuisance has been allowed to continue. As of this date, no City officials have inspected, assessed, and or even confirmed the damage to Mr. Boop's home In addition, Councilman Dietz has used your head of planning, to sever Mr. Boop's right of access to his government, to bully and harass, stone-wall and discriminate, and involve this City and it's Council in gross negligence and fraud. All of the above has and is causing great emotional and physical stress to William Boop. In order for you to avoid the embarrassment and expense of imminent civil, and pOEsible criminal action against Councilman Dietz, the City of Elk River and or it's insurance company, I now make demand for settlement as fOllows: 1) City of Elk River .to immediately and completely eliminate the earthen barrier, built along the north side cf the rail-road tracks, adjacent to County #35, between Ogdon and Troy Streets. 2) City of Elk River to re-open the engineering phase of the Windsor Oaks development. Specifically, to re-address the dredging of the wet lands, movement of huge amounts of earth, and the relation- ship of those actions on the rail-road tracks and bed. Then City to reverse the recent, violent train-track vibration back to normal, ( at or near zero)
