W. <br />Elk River, Mn 55330 <br /> <br />City of Elk River <br />13065 Orono Parkway <br />Elk River, Mn 55330 <br /> <br />March 21, 2005 <br /> <br />Dear City of Elk River: <br /> <br />Several E-mail, letters, and phone calls, have been made to <br />Councilman Dietz, and other City officials, dating baclc to March <br />2003, with claims of recent, violent, train-track vibration damage <br />to Mr. Boop's personal property. The damage to Mr. Boop's home <br />has been extensive, and continues to rapidly deteriorate, as the <br />vibration nuisance has been allowed to continue. As of this date, <br />no City officials have inspected, assessed, and or even confirmed <br />the damage to Mr. Boop's home <br /> <br />In addition, Councilman Dietz has used your head of planning, to <br />sever Mr. Boop's right of access to his government, to bully and <br />harass, stone-wall and discriminate, and involve this City and it's <br />Council in gross negligence and fraud. All of the above has and <br />is causing great emotional and physical stress to William Boop. <br /> <br />In order for you to avoid the embarrassment and expense of imminent <br />civil, and pOEsible criminal action against Councilman Dietz, the <br />City of Elk River and or it's insurance company, I now make demand <br />for settlement as fOllows: <br /> <br />1) City of Elk River .to immediately and completely eliminate the <br />earthen barrier, built along the north side cf the rail-road tracks, <br />adjacent to County #35, between Ogdon and Troy Streets. <br /> <br />2) City of Elk River to re-open the engineering phase of the Windsor <br />Oaks development. Specifically, to re-address the dredging of <br />the wet lands, movement of huge amounts of earth, and the relation- <br />ship of those actions on the rail-road tracks and bed. Then City <br />to reverse the recent, violent train-track vibration back to normal, <br />( at or near zero) <br />
