Consideration of Limited Subdivision and Improvement Moratorium/Public <br />Hearing <br /> <br />e <br /> <br />The City Administrator indicated that the Council adopted an ordinance at <br />the January 4. 1988. City Council meeting which called for a moratorium on <br />the subdivision and improvement of certain unsewered lands within the <br />City. The City Administrator explained that the Council will be <br />considering extending the moratorium. The City Administrator displayed <br />the map which shows the areas affected by the moratorium. <br /> <br />Mayor Gunkel opened the public hearing at this time. <br /> <br />Cliff Lundberg questioned the area on the map with the cross marks <br />representing the area of the City in which overlays are required. Mr. <br />Lundberg indicated his concern as to whether the City will allow <br />development with an overlay in the "marked" property on the map. The <br />City Administrator indicated subdivisions with overlays would be allowed <br />in this area during the moratorium. <br /> <br />Mayor Gunkel closed the public hearing. <br /> <br />COUNCILMEMBER TRALLE MOVED TO ADOPT ORDINANCE 88-13. AN ORDINANCE <br />ESTABLISHING THE NEED FOR AND DIRECTING THE IMPOSITION OF A MORATORIUM ON <br />THE SUBDIVISION AND IMPROVEMENT OF CERTAIN UNSEWEREDLANDS WITHIN THE <br />CITY. COUNCILMEMBER HOLMGREN SECONDED THE. MOTION. THE .MOTION CARRIED 5- <br />O. <br /> <br />6.1.Councilmember Schuldt <br /> <br />e <br /> <br />Councilmember Schuldt questioned what rights the City has in regards to <br />the outside appearance and upkeep of rental property. He indicated there <br />are some rental areas in Elk River that are starting to look run down. <br />The City Administrator explained that the City has no more rights with <br />outside appearance of rental property than they do with privately owned <br />property. He further indicated that the City has no rights to inspect the <br />inside of dwellings after the certificate of occupancy has been issued. <br />
