<br />City Council Minutes <br />December 17, 1990 <br /> <br />Page 7 <br /> <br />e <br /> <br />indicated that City staff will contact Mr. Stromberg regarding this <br />issue, as this does not pertain to the conditional use permit. <br /> <br />Rob VanValkenburg indicated that the Planning Commission discussed this <br />issue at length and recommended approval based on the seven standards <br />required for a conditional use permit. Mr. VanValkenburg indicated <br />that there were several neighbors at the Planning Commission <br />complaining of the unsightliness of Mr. Nitz's yard. He further <br />indicated that it was the consensus of the Planning Commission, and Mr. <br />Nitz's intention, that when the accessory building is constructed, the <br />materials laying outside will be enclosed in the building. <br /> <br />There being no further comments, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER SCHULDT MOVED TO APPROVE THE CONDITIONAL USE PERMIT <br />REQUESTED BY TED NITZ TO CONSTRUCT A NONAGRICULTURAL ACCESSORY BUILDING <br />IN EXCESS OF 1,000 SQUARE FEET ON HIS PROPERTY LOCATED AT 18942 ALBANY <br />STREET NW WITH THE FOLLOWING CONDITIONS: <br /> <br />1. That the applicant must submit engineered drawings with the <br />building permit application. <br /> <br />2. That the building is to be used for storage only. <br /> <br />e <br /> <br />3. <br /> <br />That the exterior of the building will match the existing house. <br /> <br />4. That when the new building is completed, the metal skinned shed <br />must be removed. <br /> <br />5. That all inoperable vehicles and car parts be kept in the new <br />facility and further, that if this condition is not met, it could <br />result in the revocation of this permit. <br /> <br />COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION CARRIED 5-0. <br /> <br />6.6 Variance Request by Circle C Convenience Center/P.H. <br /> <br />Janelle Szklarski, Zoning Assistant, indicated that Circle C <br />Convenience Center located at 336 Jackson Avenue is requesting a <br />variance to allow the height of a freestanding sign to exceed the <br />height of the roofline of the building. She stated that the Planning <br />Commission recommended denial of the request due to the fact that the <br />request did not meet the hardship standards required for a variance. <br />Ms. Szklarski indicated that the Planning Commission recommended that <br />Circle C's request be reviewed as a relocation of a nonconforming sign. <br /> <br />e <br /> <br />Planning Commission Representative Rob VanValkenburg stated that the <br />Planning Commission recommended that approval be granted to Circle C <br />for the relocation of a nonconforming sign as they felt it would be in <br />the best interest of the community because the sign would no longer be <br />in the right-of-way. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br />
