<br />City Council Minutes <br />June 18, 1990 <br /> <br />Page 7 <br /> <br />e <br /> <br />Pat Klaers, City Administrator, indicated that he would like to address <br />the Council on behalf of the Park and Recreation Commission. He stated <br />that the Park and Recreation Commission has a concern regarding <br />existing platted property. He stated that the concern related toward <br />apartment complexes being able to build on existing platted property <br />which would not allow the City to collect park dedication fees. He <br />indicated that their concern is that the Council look carefully at the <br />zoning of commercial, industrial and multi-family industrial properties <br />so that the City does not get in a position of losing park dedication <br />fees from apartment complexes. <br /> <br />Councilmember Holmgren arrived at this time (7:50 p.m.) <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO ADOPT ORDINANCE 90-13, AN ORDINANCE <br />AMENDING THE CODE OF ORDINANCES FOR THE CITY OF ELK RIVER SECTIONS <br />900.38 AND 1008.04, RELATING TO THE SUBDIVISION OF LAND. COUNCILMEMBER <br />SCHULDT SECONDED THE MOTION. THE MOTION CARRIED 4-0-1. <br />Councilmember Holmgren abstained. <br /> <br />6.10 Ordinance Amendment Section 1008.16 Fences in Easements/City of Elk <br />~iver/P.H. <br /> <br />e <br /> <br />Mayor Tralle indicated that the City is requesting an ordinance <br />amendment which would assure the maintenance of sewer lines and other <br />utilities within easements while still allowing fences in the <br />easement. He indicated that by prohibiting fences and other <br />obstructions in utility easements, the City would be able to maintain <br />all sewer lines. <br /> <br />Ri ta Johnson, Planning Commission Representative, indicated that the <br />Planning Commission unanimously recommended approval of this request. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />COUNCILMEMBER KROPUENSKE MOVED TO ADOPT ORDINANCE 90-14, AN ORDINANCE <br />AMENDING SECTION 1008 . 16-EASEMENTS , SUBDIVISION 1, PROVIDED FOR <br />UTILITIES. COUNCILMEMBER DOBEL SECONDED THE MOTION. THE MOTION <br />CARRIED 5-0. <br /> <br />6.11 Ol."9inance Amendment Section 900.12 Permitted ang Condi tional Uses in <br />C-2 and C-3 Zopes~ity of Elk River/P.H. <br /> <br />Steve Rohlf, Building and Zoning Administrator, indicated that the <br />Mayor had requested the Planning Commission to review permitted and <br />conditional uses within the C-2 and C-3 Highway Commercial zones. <br /> <br />e <br /> <br />Planning Commission Representative Arlon Fuchs indicated that the <br />Planning Commission recommended that no changes be made in the C-2 <br />zone. He further stated that the Commission recommended that Class II <br />restaurants, motor vehicle service stations, car washes and specialty <br />service stations be moved from permitted uses to conditional uses in <br />the C-3 zone. <br />
