<br />. <br /> <br />. <br /> <br />. <br /> <br />Elk River City Council Minutes <br />April 20, 1992 <br /> <br />Page 6 <br /> <br />STAFF HAS THE RIGHT TO INSPECT THE PREMISES AT ANY REASONABLE HOUR <br />FOLLOWING NOTIFICATION. <br /> <br />10. <br /> <br />THAT THE NORMAL HOURS OF OPERATION FOR THE PLANT ARE FROM 7:00 <br />A.M. TO 7:00 P.M., SEVEN DAYS A WEEK. HOWEVER, HOURS CAN BE <br />EXTENDED TO SPECIAL CASES BY THE BUILDING AND ZONING ADMINISTRATOR <br />AS LONG AS THE AS THE ADDITIONAL HOURS DO NOT CREATE A NUISANCE <br />FOR SURROUNDING RESIDENCES. FURTHER MPCA NOISE LEVELS MUST BE <br />ADHERED TO AT ALL TIMES DURING THE OPERATION OF THIS PLANT. <br /> <br />11. <br /> <br />THAT THE BAGHOUSE FILTER IS TESTED ONCE PER MONTH FOR LEAKS AND <br />THE RESULTS OF THOSE TESTS ARE COPIED TO THE CITY. <br /> <br />12. THAT THIS CONDITIONAL USE PERMIT BE REVIEWED IN TWO YEARS AND A <br />NEW PERMIT BE OBTAINED AT THAT TIME. <br /> <br />13. THAT STOCKPILES OF RECYCLABLE MATERIALS NOT BE PLACED IN SURFACE <br />WATER AND FURTHER THAT RUN-OFF FROM THESE STOCKPILES IS DIRECTED <br />AWAY FROM ANY SURFACE WATER. THAT THE SIZE OF THE STOCKPILES BE <br />LIMITED TO THE AMOUNT OF MATERIAL THAT COULD POSSIBLY BE USED IN <br />ONE YEAR, BUT NOT NECESSARILY TO WHAT WILL BE USED IN ANY ONE <br />GIVEN YEAR. FURTHER, THAT THE CITY UNDERSTANDS WITH THIS <br />STIPULATION THAT SOME RECYCLABLE MATERIALS WILL BE RETAINED OVER <br />THE WINTER SO THAT RECYCLING CAN START AT THE SAME TIME AS SPRING <br />START UP FOR THE ASPHALT PLANT. <br /> <br />14. THAT COMMERCIAL ASPHALT CONTINUE TO WORK WITH CITY STAFF TO <br />RESOLVE PROBLEMS WITH ODOR AND NOISE IF THEY ARISE. <br /> <br />COUNCILMEMBER HOLMGREN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />5.5. Site Plan Review/Linda Norha/Public Hearing <br /> <br />Steve Rohlf explained that Linda Norha, represented by Gary Santwire, <br />is requesting to adjust lot lines to accommodate a 14' X 44' addition <br />to the existing building. He indicated that the addition lies within a <br />PUD and requires a site plan review. Steve Rohlf explained that Ms. <br />Norha is proposing to exchange triangular pieces of property 12' wide <br />from one lot to another. He stated that the net result would be that <br />both lots would remain the same size; however, the shape would change <br />on both lots. <br /> <br />Steve Rohlf explained that the Barrington Square PUD Agreement requires <br />Planning Commission and Council review of site plans. He stated that <br />the site plans review for the Planning Commission is scheduled at the <br />April 28, 1992, meeting and that the developer has requested permission <br />for the Council to review the site plan prior to Planning Commission <br />review. <br /> <br />Mayor Tralle opened the public hearing. There being no one for or <br />against the matter, Mayor Tralle closed the public hearing. <br /> <br />Mayor <br />would <br /> <br />Tralle noted that because this is such a minor issue, he felt it <br />be appropriate for the Council to approve the site plan, <br />
