<br />Elk River City Council Minutes <br />April 20, 1992 <br /> <br />Page 4 <br /> <br />. <br /> <br />Tim O'Brien indicated his concern regarding the noise emanating from <br />the pool hall and the fact that the windows will now be open at the <br />nursing home during the spring season. <br /> <br />Councilmember Schuldt noted that the outside of the pool hall building <br />did not have much litter around the area, but the tree line along <br />Highway 169 had a lot of litter. He noted that the police activity in <br />the general area has picked up since the pool hall opened. He further <br />stated that the City Council must be concerned with what is best for <br />the community. He noted that he must give creditability to the fact <br />that the Chief of Police has written a memo indicating violations at <br />the establishment. Councilmember Schuldt indicated he did not have a <br />problem with the original conditional use permit, but would not be in <br />favor of extending the hours. <br /> <br />Councilmember Dietz noted that it was hard to believe two hours a week <br />could make this big of a difference to the operation of the pool hall. <br /> <br />. <br /> <br />Mayor Tralle stated that there are very few places for teens to go in <br />the City and felt that to blame all the problems in the mall on the <br />pool hall would be unfair. He indicated that a two hour trial is not <br />an unreasonable request. Mayor Tralle further stated the staff has <br />received a memo from the Police Chief stating that there has been <br />management problems at the billiard hall. Mayor Tralle indicated he is <br />concerned about this problem. Mr. Wilson explained this problem <br />emanated from his youngest son managing the establishment one evening <br />and inviting his friends over and keeping the establishment open later <br />than allowed. He indicated that this would not happen again and has <br />not happened since the memo from the Police Chief. <br /> <br />Councilmember Holmgren stated that in the sense of fairness, the City <br />Council could give the pool hall a trial period. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO EXTEND THE HOURS OF OPERATION FOR THE <br />PLAYERS CLUB BILLIARDS TO 3:00 A.M. ON SATURDAYS ON A TRIAL BASIS AND <br />THAT THE TRIAL BASIS EXPIRE ON JULY 20, 1992, AT WHICH TIME THIS WOULD <br />BE BROUGHT BACK TO THE COUNCIL FOR CONSIDERATION, AND FURTHER THAT THE <br />ESTABLISHMENT WOULD REMAIN OPEN UNDER THE CURRENT CONDITIONAL USE <br />PERMIT STANDARDS. MAYOR TRALLE SECONDED THE MOTION. <br /> <br />. <br /> <br />Steve Rohlf, Building and Zoning Administrator, informed the Council <br />that this decision will not affect minors as the curfew for minors is <br />10:30 p.m. and 12:00 a.m. Steve Rohlf also indicated that during this <br />trial time period, the establishment must also be concerned with litter <br />control, adult supervision at all times, and all other aspects of the <br />original conditional use permit. He stated that at the end of the <br />three months if the Council finds that there are no problems and <br />decides to authorize the request on a permanent basis, the conditional <br />use permit can be modified. He further stated that the ordinance <br />amendment should not be considered until the Council determines whether <br />this is a permanent solution. <br /> <br />THE MOTION CARRIED 3-1. Councilmember Schuldt opposed. <br />
