The Area Learning Center is a high school diploma program <br />offered through Elk River School District 728 in a non-traditional <br />setting for students ages 14 to adult. The applicant has stated that <br />there will be a total of approximately 200 students with classes <br />operating in the morning, afternoon, and evening. <br /> <br />Staff stated that it was felt the use was compatible with the C-3 <br />commercial uses permitted in the PUD agreement. <br /> <br />Discussion ensued regarding parking at the site. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Mr. Gary Santwire stated that he was in agreement with the conditions <br />recommended by the Planning Commission. <br /> <br />Building Official Cliff Skogstad reviewed the items of concern <br />resulting from his inspection of the site in question on November 18, <br />1993 with Jeff DeJarvis, State Building Code Division; Russ Anderson, <br />Fire Chief; and Lynn Salisbary. Mr. Skogstad stated that he sent a <br />letter to Mr. Santwire listing ten concerns and asked for plans to be <br />submitted by December 3, 1993, for review. He stated that the <br />requested site plan information has not been received to date. <br /> <br />e <br /> <br />Gary Schmitz stated that the Planning Commission's recommendation <br />specified that all the concerns of the Building Official related to <br />State Building Code be addressed and completed by December 30, 1993. <br /> <br />Mr. santwire submitted a copy of a fax from National Guardian listing <br />the fire alarm equipment their company would be installing at the Area <br />Learning Center December 20-28, 1993. Mr. Santwire stated that he is <br />finding it impossible to find anyone in the construction business that <br />would be willing to work during the last week in December due to the <br />holidays, and is requesting an extension of time to January 15, 1994, <br />to complete the necessary changes for Code compliance. <br /> <br />There being no further comments from the public, Mayor Duitsman closed <br />the public hearing. <br /> <br />COUNCILMEMBER DIETZ MOVED TO APPROVE THE CONDITIONAL USE PERMIT REQUEST <br />BY R.E.P., LTD., TO AMEND THE DEVELOPMENT AGREEMENT FOR BARRINGTON <br />SQUARE TO ALLOW INSTITUTIONAL USES AND A SITE PLAN REVIEW OF THE AREA <br />LEARNING CENTER HIGH SCHOOL WITH THE FOLLOWING CONDITIONS: <br /> <br />1. THE NUMBER OF STUDENTS BE LIMITED (PER SHIFT) BASED ON THE TOTAL <br />NUMBER OF PARKING STALLS AVAILABLE. <br /> <br />2. A JOINT PARKING AGREEMENT FOR LOTS 1, 2, AND 3, BARRINGTON SQUARE, <br />BE RECORDED IF NECESSARY TO MEET CONDITION NUMBER 1. <br /> <br />3. SIGNAGE MEET C3 STANDARDS. <br /> <br />e <br /> <br />4. <br /> <br />ALL THE CONCERNS OF THE BUILDING OFFICIAL RELATED TO STATE <br />BUILDING CODES BE ADDRESSED AND COMPLETED BY JANUARY 10, 1994. <br />
