The conflict pertained to his employment. <br /> <br />9. Staff Update <br /> <br />The City Administrator informed the Council that staff is receiving calls regarding <br />the drainage improvement activity taking place in the Deerfield 3rd Addition. He <br />indicated that other residents are requesting the City to correct their individual <br />drainage problems. <br /> <br />The City Council recessed at 6:52 p.m. and reconvened at 7:00 p.m. <br /> <br />5. Open Mike <br /> <br />No one appeared for this item. <br /> <br />6.3. <br /> <br />Renewal of Conditional Use Permit for Commercial Asohalt/Public Hearina - CU <br />94-7 <br /> <br />e <br /> <br />Steve Rohlf, Building and Zoning Administrator, indicated that Commercial <br />Asphalt is requesting a two-year renewal of their conditional use permit for a <br />temporary asphalt plant. <br /> <br />Dan Tveite, Planning Commission Representative, indicated that there was <br />opposition to the request at the Planning Commission public hearing. The <br />opposition was mainly to the odor. The Planning Commission recommended <br />approval of the request for a one year renewal and with a review in June to see <br />whether corrective action has been taken regarding the odor. <br /> <br />Vice Mayor Farber opened the public hearing. <br /> <br />Gary Sauer of Commercial Asphalt, indicated that they would be working on a <br />solution to the odor problem. <br /> <br />There being no further comments, Vice Mayor Farber closed the public hearing. <br /> <br />COUNCILMEMBER SCHEEL MOVED TO APPROVE A ONE-YEAR RENEWAL OF THE <br />CONDITIONAL USE PERMIT FOR COMMERCIAL ASPHALT BASED ON THE FOLLOWING <br />STIPULATIONS: <br /> <br />1. <br /> <br />THAT A MAXIMUM OF 30% RECYCLED ASPHALT CAN BE USED IN THE <br />OPERATION IN ORDER TO CONTROL ODOR. IF WEATHER CONDITIONS MAKE <br />ODOR TOO NOTICEABLE, THE OPERATOR MUST TEMPORARILY REDUCE THE <br />PERCENTAGE OF RECYCLED ASPHALT IN THEIR OPERATION UNTIL <br />ATMOSPHERIC CONDITIONS ALLOW THE 30% LEVEL TO CONTINUE. <br /> <br />e <br /> <br />2. THAT THE LEAD CONCENTRATION IN FUEL OIL COMPLY WITH CURRENT MPCA <br />REGULATIONS OR BE NO MORE THAN 4,000 MG/KG, WHICHEVER IS LESS. <br />
