<br />City Council Minutes <br />July 25, 1994 <br /> <br />Page 9 <br /> <br />e <br /> <br />Emery LaPointe, 18294 Naples St. NW..indicated that not being allowed to <br />subdivide the property would not change the assessment amount other than the <br />trunk fee. He indicated that first he was informed that he could subdivide his lot; <br />and now the Council is considering not allowing him to subdivide. <br /> <br />Becky Burley, 183rd Ave. NW...stated that the residents do not want to hamper <br />city development. however, she urged the Council to consider what the <br />assessment will mean to the families in the development. She stated she will have <br />to cancel their "first" family vacation, pull her children from activities, and either <br />go to work or have her husband get a second job. She stated that this is a <br />financial hardship on the family. She further indicated that some of the people in <br />the area would not qualify for a mortgage if this fee were added to the cost of <br />their home. <br /> <br />Mayor Duitsman closed the public hearing at this time. <br /> <br />. COUNCILMEMBER DIETZ MOVED TO ADOPT RESOLUTION 94-81, A RESOLUTION <br />ORDERING THE IMPROVEMENT IN THE MATTER OF THE WESTERN AREA 2ND PHASE <br />TRUNK SANITARY SEWER, WATER, STORM SEWER, AND STREET IMPROVEMENT OF 1994. <br />COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.1. <br /> <br />Consider a variance reauest bv Jason Volkers, PUBLIC HEARING, Case #V 94-7 <br /> <br />e <br /> <br />Planning Assistant Gary Schmitz indicated that the variance requested by Jason <br />Volkers, to exceed the maximum size of an accessory building, was tabled by the <br />City Council at its last meeting. Gary Schmitz reviewed the request. He indicated <br />that both Planning Commission and staff are recommending denial based on the <br />fact that no valid hardship could be determined. <br /> <br />Gary Schmitz suggested that the Council consider an ordinance amendment as <br />opposed to a variance. <br /> <br />Mayor Duitsman suggested that the issue relating to size of accessory structures <br />be referred to the Planning Commission for study. <br /> <br />Council member Scheel stated that there is adequate space for the building. <br /> <br />COUNCILMEMBER SCHEEL MOVED TO GRANT A VARIANCE TO JASON VOLKERS TO <br />ALLOW A 930 SQUARE FOOT ACCESSORY BUILDING AND TO REFER THE ISSUE OF <br />ACCESSORY STRUCTURE SIZE TO THE PLANNING COMMISSION FOR STUDY. <br />COUNCILMEMBER FARBER SECONDED THE MOTION. MOTION FAILED 2-2. <br />COUNCILMEMBER DIETZ AND MAYOR DUITSMAN OPPOSED. <br /> <br />COUNCILMEMBER SCHEEL MOVED TO TABLE THE ISSUE FOR ONE WEEK SO THAT IT <br />COULD BE VOTED ON BY THE WHOLE COUNCIL. COUNCILMEMBER FARBER <br />SECONDED THE MOTION. <br /> <br />Council member Dietz stated that there is no basis to grant a variance in this <br />instance. <br /> <br />e <br /> <br />THE MOTION CARRIED 4-0. <br />
