Elk River City Council Meeting
June 27, 1994

Page 4

e

8.1.

Request for final plat approval for Country Crossinas by Country Ridae Partnership
- P 94-02

City Planner Steven Ach indicated that Country Ridge Partnership is requesting
final plat approval of Country Crossings to subdivide approximately forty (40)
acres into seventy three (73) single family lots.

steve Ach indicated that the developers of the plat will dedicate park land
along Orono Parkway to preserve the existing oak trees. He further indicated that
Joplin Street and Orono Parkway will be constructed as part of the plat. Another
condition of the plat is that ninety (90) feet of street, drainage and utility
easement be granted for the extension of Joplin Street from Orono Parkway to
Highway 10.

Discussion was held regarding a recent Supreme Court decision regarding cities
requesting easements from developers and how this decision would affect the
conditions of the Country Crossings Plat. After discussion of this issue, it was
decided to approve the plat with the existing condition regarding the easement,
and that the condition could be changed in the Developer's Agreement within
30 days if necessary.

COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 94-71, A RESOLUTION
GRANTING FINAL PLAT FOR COUNTRY CROSSINGS. COUNCILMEMBER DIETZ
SECONDED THE MOTION.

e

Discussion was held regarding the possibility of additional land being acquired for
the realignment of Orono Park and how this would affect the final plat. steve
Ach suggested adding an extra condition to the Resolution approving the plat to
deal with this situation.

THE MOTION WAS WITHDRAWN BY COUNCILMEMBER HOLMGREN AND
COUNCILMEMBER DIETZ.

The City Administrator indicated that the neighbors have not been notified of the
sedimentation pond that will be required. Discussion was held regarding the
fencing of the sedimentation pond. Steve Ach indicated that staff does not feel
it is necessary to fence the pond, however, if the Council should require fencing,
the cost should be borne by the developer.

COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 94-71, A RESOLUTION
GRANTING FINAL PLAT FOR COUNTRY CROSSINGS AS AMENDED BY ADDING
CONDITION 17 ADJUSTING THE PLAT ACCORDINGLY DEPENDING UPON THE
REALIGNMENT OF ORONO PARKWAY, AND ITEM #18 RELATING TO THE POSSIBLE
FENCING OF THE SEDIMENTATION POND. COUNCILMEMBER DIETZ SECONDED THE
MOTION. THE MOTION CARRIED 4-0.

8.2.

Request for final plat approval for Heritaae Landina 2nd Addition by Heritaqe
Landina Development Company - P 93-12

e

Steven Ach, City Planner, indicated that Heritage Landing Development
Company is requesting final plat approval of Heritage Landing Second Addition
