<br />Elk River City Council Meeting <br />June 27, 1994 <br /> <br />Page 4 <br /> <br />e <br /> <br />8.1. <br /> <br />Request for final plat approval for Country Crossinas by Country Ridae Partnership <br />- P 94-02 <br /> <br />City Planner Steven Ach indicated that Country Ridge Partnership is requesting <br />final plat approval of Country Crossings to subdivide approximately forty (40) <br />acres into seventy three (73) single family lots. <br /> <br />steve Ach indicated that the developers of the plat will dedicate park land <br />along Orono Parkway to preserve the existing oak trees. He further indicated that <br />Joplin Street and Orono Parkway will be constructed as part of the plat. Another <br />condition of the plat is that ninety (90) feet of street, drainage and utility <br />easement be granted for the extension of Joplin Street from Orono Parkway to <br />Highway 10. <br /> <br />Discussion was held regarding a recent Supreme Court decision regarding cities <br />requesting easements from developers and how this decision would affect the <br />conditions of the Country Crossings Plat. After discussion of this issue, it was <br />decided to approve the plat with the existing condition regarding the easement, <br />and that the condition could be changed in the Developer's Agreement within <br />30 days if necessary. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 94-71, A RESOLUTION <br />GRANTING FINAL PLAT FOR COUNTRY CROSSINGS. COUNCILMEMBER DIETZ <br />SECONDED THE MOTION. <br /> <br />e <br /> <br />Discussion was held regarding the possibility of additional land being acquired for <br />the realignment of Orono Park and how this would affect the final plat. steve <br />Ach suggested adding an extra condition to the Resolution approving the plat to <br />deal with this situation. <br /> <br />THE MOTION WAS WITHDRAWN BY COUNCILMEMBER HOLMGREN AND <br />COUNCILMEMBER DIETZ. <br /> <br />The City Administrator indicated that the neighbors have not been notified of the <br />sedimentation pond that will be required. Discussion was held regarding the <br />fencing of the sedimentation pond. Steve Ach indicated that staff does not feel <br />it is necessary to fence the pond, however, if the Council should require fencing, <br />the cost should be borne by the developer. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 94-71, A RESOLUTION <br />GRANTING FINAL PLAT FOR COUNTRY CROSSINGS AS AMENDED BY ADDING <br />CONDITION 17 ADJUSTING THE PLAT ACCORDINGLY DEPENDING UPON THE <br />REALIGNMENT OF ORONO PARKWAY, AND ITEM #18 RELATING TO THE POSSIBLE <br />FENCING OF THE SEDIMENTATION POND. COUNCILMEMBER DIETZ SECONDED THE <br />MOTION. THE MOTION CARRIED 4-0. <br /> <br />8.2. <br /> <br />Request for final plat approval for Heritaae Landina 2nd Addition by Heritaqe <br />Landina Development Company - P 93-12 <br /> <br />e <br /> <br />Steven Ach, City Planner, indicated that Heritage Landing Development <br />Company is requesting final plat approval of Heritage Landing Second Addition <br />
