<br />Elk River City Council Minutes <br />April 4, 1994 <br /> <br />Page 2 <br /> <br />e <br /> <br />1, Ridgewood East Second Addition. The City Administrator stated that this parcel <br />of property was acquired by the City through tax forfeiture. He stated that the <br />City paid assessments on the lot plus $3,900. He further indicated that the parcel <br />of property is used mainly for drainage in the area. <br /> <br />Roger Kostreba and Todd Anderson, representing the Boy Scouts, addressed the <br />Council regarding this issue. Roger Kostreba indicated that the American Legion <br />donated $15,000 to the Boy Scouts to construct the facility. He stated that the <br />building will be used by three Boy Scout Troops. Roger Kostreba indicated that <br />the Boy Scouts are requesting that the City own the building and the property as <br />the Boy Scouts cannot own a property or building. He further indicated that the <br />property the Boy Scouts are requesting to use blends in with the area as there are <br />mini-storage buildings located next to the property. He stated that the Boy <br />Scouts have their own liability insurance. <br /> <br />Discussion was held by the Council regarding issues such as the effect this would <br />have on the City's liability insurance, the possibility of the City selling the property <br />to the Boy Scouts, other groups using the facility, and possibly adding on to the <br />facility at a future date, ownership of the land, and the effects building on the <br />property would have on the overall storm drainage plan. Following discussion of <br />these issues, it was the consensus of the Council that they were in favor of the <br />proposal, however, certain issues and details would have to be worked out with <br />the City's Attorney and staff. The City Administrator suggested that the Boy <br />Scouts start the conditional use permit process while City staff works on other <br />issues regarding this matter. <br /> <br />e <br /> <br />5.3. <br /> <br />Consider Resolution Orderinq Public Hearinq for Northeast Area Trunk Sanitary <br />Sewer and Water Improvements <br /> <br />Pat Klaers, City Administrator, indicated that the trunk sanitary sewer and water <br />improvements proposed in the Elk Park Center feasibility study will serve a much <br />larger area including many acres on the east side of T.H. 169. He indicated that <br />in order to proceed with these improvements, the property owners to be assessed <br />will either have to waive their rights to a public hearing or a public hearing will <br />have to be held. He indicated that it is unlikely that the waivers of the right to a <br />public hearing could be easily and quickly obtained and stated that staff is <br />suggesting that the Council hold a public hearing for this project. <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO ADOPT RESOLUTION 94-29, A RESOLUTION <br />RECEIVING THE FEASIBILITY REPORT AND ORDERING A PUBLIC HEARING ON THE <br />IMPROVEMENT IN THE MATTER OF THE TRUNK SANITARY SEWER AND WATER <br />IMPROVEMENT OF 1994. COUNCILMEMBER DIETZ SECONDED THE MOTION. THE <br />MOTION CARRIED 3-0. <br /> <br />5.4. <br /> <br />Consider City Unity Day Resolution <br /> <br />e <br /> <br />The City Administrator stated that the League of Minnesota Cities is requesting all <br />cities to unite together in declaring April 21, 1994, as Minnesota Cities Unity Day. <br />Mayor Duitsman stated he is opposed to the proposal as he does not feel the <br />League should be supporting something that needs to be changed; referring <br />specifically to the property tax system. <br />
