<br />Elk River City Council Meeting <br />July 24, 1995 <br /> <br />Page 7 <br /> <br />e <br /> <br />subdivision ordinance. Steve Ach reviewed the noticeable changes in the <br />ordinance at this time. <br /> <br />The City Council held discussion regarding proposed changes to page 4.2 <br />regarding park dedication. Steve Ach reviewed the advantages and <br />disadvantages of requiring the developers to install trails. Councilmember <br />Holmgren indicated that the Council has yet to see the park comprehensive plan <br />at this time. He further indicated that the City Council has not indicated that it is <br />in favor of linking plats with trails. Councilmember Holmgren indicated that he is <br />not in favor of trail construction linking the entire community. <br /> <br />Steve Ach distributed a letter from John Oliver and Associates with suggestions <br />regarding the proposed amendments to the subdivision ordinance. Steve Ach <br />indicated that all of John Oliver's comments will be incorporated into the <br />ordinance. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Marly Glines suggested that trails be provided through the park dedication <br />process and credit be given if developers must install trails. <br /> <br />e <br /> <br />Rick Foster suggested that the burden of ensuring that trees are provided on <br />each property be the responsibility of the builder. City Planner Steve Ach <br />indicated that it would be difficult for the city staff to enforce this issue with the <br />builders and require trees at time of certificate of occupancy without some <br />escrow system. <br /> <br />Council member Scheel indicated her opposition to the city indicating where <br />trees are to be planted. <br /> <br />Council member Farber indicated that he feels there are too many fees and <br />responsibilities to the developers. He indicated that he cannot support the issue <br />of the developer being responsible for the trees. <br /> <br />Council member Farber indicated his concern regarding changing the <br />administrative subdivision requirements from four lots to two lots. He indicated <br />that the platting process to go through a preliminary plat with four lots is much <br />more expensive than going through an administrative subdivision. <br />Council member Farber suggested that staff make no change to this portion of <br />the ordinance. <br /> <br />The City Council concluded that no decision would be made on the trail issue <br />until the comprehensive plan has been completed. <br /> <br />There being no further business, Mayor Duitsman closed the public hearing. <br /> <br />COUNCILMEMBER FARBER MOVED TO ADOPT ORDINANCE 95-15, AN ORDINANCE <br />AMENDING SECTION 1008 OF THE CITY OF ELK RIVER ZONING ORDINANCE WITH THE <br />FOLLOWING CONDITIONS: <br /> <br />1. <br /> <br />TO ELIMINATE NUMBER 3 OF SECTION 1008.18 RELATING TO TRAILS AND <br />SIDEWALKS. <br /> <br />e <br />
