Gary Schmitz reviewed his staff report on this <br />issue. <br /> <br />Mayor Duitsman opened the public hearing. <br /> <br />Curt Muller, 19815 Zebulon, indicated his concern regarding the distance of the <br />road from his residence and the drainage problems that he is experiencing. <br />Steve Ach indicated that the design of the curbs in the plat should eliminate the <br />water problems Mr. Muller is experiencing. <br /> <br />There being no further comments from the public. Mayor Duitsman closed the <br />public hearing. <br /> <br />Councilmember Holmgren addressed the condition regarding the requirement of <br />the developer to repair the tile on Ditch 28. Councilmember Holmgren indicated <br />that this may not be possible as the county is still responsible for the ditches. Gary <br />Schmitz indicated that staff is working with the county on this issue. <br /> <br />Councilmember Holmgren further indicated his concern with Condition # 13. <br />Redistribution of the Ditch Assessment Prior to Recording the Plat. <br />Council member Holmgren indicated that this may hold up the recording of the <br />plat. <br /> <br />e <br /> <br />COUNCILMEMBER HOLMGREN MOVED TO APPROVE THE PRELIMINARY PLAT OF <br />WEATHERWOOD SUBDIVISION TO SUBDIVIDE APPROXIMATELY 80 ACRES INTO 21 <br />SINGLE FAMILY LOTS BASED ON THE FOLLOWING CONDITIONS: <br /> <br />1. A DEVELOPMENT AGREEMENT BE PREPARED OUTLINING THE TERMS AND <br />CONDITIONS FOR PLAT APPROVAL AND INSTALLATION OF IMPROVEMENTS. <br /> <br />2. COMMENTS OUTLINED IN THE CITY ENGINEER'S MEMO DATED JUNE 21, 1995, BE <br />ADDRESSED AND INCORPORATED INTO FINAL PLANS FOR THE DEVELOPMENT. <br /> <br />3. A SURFACE WATER MANAGEMENT FEE IN THE AMOUNT REQUIRED BY THE CITY <br />AT THE TIME OF FINAL PLATTING BE PAID PRIOR TO RECORDING THE PLAT. <br /> <br />4. PARK DEDICATION FEES BE PAID BASED ON THE PER LOT RATE AT THE TIME OF <br />FINAL PLAT APPROVAL. THIS FEE SHALL BE PAID PRIOR TO RELEASE OF FINAL <br />PLAT. <br /> <br />5. ALL OF THE APPROPRIATE PERMITS TO FILL AND MITIGATE WETLANDS. BE <br />APPROVED PRIOR TO FINAL PLAT APPROVAL. <br /> <br />6. A TREE PRESERVATION PLAN BE SUBMITTED WITH EACH BUILDING PERMIT WHERE <br />HOMES ARE CONSTRUCTED IN WOODED AREAS. <br /> <br />7. AN NPDES PERMIT BE OBTAINED FOR THE GRADING ASSOCIATED WITH THE <br />DEVELOPMENT PRIOR TO COMMENCING ANY GRADING ACTIVITY. <br /> <br />8. PROPER EROSION CONTROL BE PROVIDED DURING CONSTRUCTION. <br /> <br />e <br /> <br />9. THE DEVELOPER REIMBURSE THE CITY FOR COSTS ASSOCIATED WITH REVIEWING <br />THIS PLAT PRIOR TO RELEASING THE FINAL PLAT FOR RECORDING. <br />
