E04y1� ,.,�� Request for Action <br /> River <br /> To Item Number <br /> Mayor and City Council 7.1 <br /> Agenda Section Meeting Date Prepared by <br /> Public Hearin s October 16, 2017 Chris Leeseber , Senior Planner <br /> Item Description Reviewed by <br /> Ordinance Amendment: Commercial Kennels in Zack Carlton,Planning Manager <br /> Highway Commercial District Reviewed by <br /> Cal Portner, City Administrator <br /> Action Requested <br /> Adopt,by ordinance, the proposed amendment to Sections 30-1024 (d), C-3 highway commercial district. <br /> Purpose of the Ordinance Amendment <br /> The City of Elk River (applicant) is requesting the ordinance amendment to allow Commercial Kennels in <br /> the C-3 zoning district. <br /> Public Benefit <br /> Provides additional pet"day care" options for residents and employees in facilities near the core business <br /> areas of Elk River. <br /> Background/Discussion <br /> During a City Council Open Forum, a business owner requested the City Council consider allowing <br /> commercial kennels in the C-3 (Highway Business) district. The owner currently operates a dog <br /> grooming business which is allowed but wants to offer the ability to kennel dogs for the day in the same <br /> facility. The Council was supportive of the idea and directed staff to explore it. <br /> A commercial kennel is defined as any premises where more than three animals over six months of age <br /> are boarded, trained or bred for compensation or are offered for sale, except for animals being raised as <br /> agricultural livestock, an animal hospital, a veterinary clinic or a pet shop. <br /> Staff is proposing to amend the C-3 language to be consistent with the C-1 language as follows: <br /> Sec. 30-1024— C-3 highway commercial district. <br /> (d) Conditional uses. Conditional uses in the C-1 district are as follows: <br /> (28) Commercial Kennel provided the following conditions are met: <br /> (a) No long term boarding exceeding 14 days takes place <br /> (b) No breeding for compensation or sale takes place <br /> (c) The sale of animals shall not take place <br /> The C-3 district has the largest businesses both in terms of size and traffic generation and recognizes the <br /> need for commercial establishments on or with immediate access to major highways.
