Access Drive Easement Agreement: allows the Country Club to construct the
access road over park property and requires them to maintain it.
3. License Agreement: allows continued use of the golf course for ski trails
November through April each year. The agreement acknowledges that a portion
of the license area may be used for future development for uses other than a golf
course.

The land exchange is consistent with the City's Comprehensive Plan.

City Council Action, September 20, 1999
At the September 20, 1999 Council meeting, Park and Recreation Commission Dave
Anderson requested that the City Council return the easement and license agreements
to the Park and Recreation and Planning Commissions for further review. His concern
was with the lack of permanence of the license agreement. The Council concurred with
the request.

Park and Recreation/Country Club Meetinq, October 6, 1999
Representatives from the Park and Recreation Commission and the Country Club met
on October 6, 1999 to discuss the options for creating a permanent easement
exchange over the golf course property. After much discussion, it was agreed that the
golf course would grant the City a permanent 66-foot wide easement parallel and
adjacent to the westerly right of way line of the railroad trail over any portion of the
property where the license has terminated (refer to italicized wording pages two and
three in attached license agreement).

Recommendation

Staff recommends that the City Council approve Resolution 99-_ and the attached
easement/license agreements.
