The PUD agreement includes specific site lighting requirements meant to address impacts from <br /> commercial operations to the residential properties. All lighting will need to comply with the standards <br /> described in the PUD agreement. <br /> The only exit from the site will be on Yale St. and many of the commercial uses authorized by the PUD <br /> agreement would be open later than a typical 9 a.m. to 5 p.m. business. Due to the exit location, <br /> headlights will shine west towards the residential properties but prohibition of all uses open later than 5 <br /> p.m. should not be considered grounds for denial of the CUP. Examples include retail stores, <br /> convenience stores (without gas),restaurants (fast-food& sit-down), and amusement and recreation uses. <br /> Casey's submitted an updated site plan showing a smaller building footprint and satisfaction of the <br /> parking standards required in city ordinances. They are no longer requesting to count the areas in front of <br /> the pumps as designated parking spaces. <br /> The residential properties along the private street are separated from the commercial properties along <br /> Yale Street by a 60-foot right-of-way, a 35-foot outlot that includes a private street, and an additional 10- <br /> foot building setback. This means that the homes are at least 105 feet from any commercially-zoned <br /> property, and are buffered from traffic along Yale St. by a private street and a landscaped median. <br /> The Planning Commission echoed many of the residents' concerns and recommended denial of the <br /> application by a 6-1 vote.
