Based on our discussions, I <br />have modified the Pay Application to reflect charging liquidated damages since the facility is not ready <br />for full use in the amount of $500/day for the 59 day period between pay application 31 and 32. This <br />reduces the requested amount by $29,500. This pay request also reduces the retainage to 1% which still <br />leaves $166,073.08 in retainage. I recommend that payment be made in the amount shown.
