<br />. <br /> <br />. <br /> <br />. <br /> <br />The HPC does not create a mechanism for land or building owners, who's property <br />has been designated as Heritage Preservation Site, to solicit funds from the city. In <br />fact, members of the citizen group that researched the HPC and are recommending it <br />to the Council own some of the most historic sites in Elk River. They have concerns <br />that it does not become another layer of cumbersome bureaucracy. <br /> <br />The HPC is also not about collecting artifacts. This is the responsibility of the <br />Sherburne County Historical Society, which is set up to properly preserve these items. <br /> <br />. <br /> <br />Case # OA 99-7 adds definitions of a Heritage Preservation Commission and a <br />Heritage Preservation Site to Section 900.08 of the City of Elk River Code of <br />Ordinances. <br /> <br />. <br /> <br />Case # OA 99-8 establishes a Heritage Preservation Site Overlay District in Section <br />900.10 ofthe City of Elk River Code of Ordinances. <br /> <br />. <br /> <br />Case # OA 99-9 elaborates on the uses and administrative procedures for a Heritage <br />Preservation Site Overlay District in Section 900.12 ofthe City of Elk River Code of <br />Ordinances. <br /> <br />The designation of a Historic Preservation Site is done through an overlay zoning <br />district. A zone change takes a four fifths vote of the City Council. Staff sees this <br />mechanism being used very sparingly and mostly at the property owner's request. <br /> <br />Recommendation <br />SHPO has reviewed the proposed ordinances and has determined that they meet the <br />State's requirements for establishing a HPC. The attached ordinance amendments also <br />reflect the changes recommended by the City Attorney and Planning Commission. No <br />opposition to establishing a HPC was voiced at the Planning Commission's public <br />hearing, only support. Staff and the Planning Commission are both recommending <br />approval of the four attached ordinance amendments, establishing a HPC in Elk <br />River. <br /> <br />\ \elkriver\sys\shrdoc\b&z\stever\camascup.doc <br />
