<br />The Planning Commission asked for clarification on the proposed stormwater treatment plans and how <br />the current setback ordinances apply. The stormwater easements are designed to fill with water during <br />heavy rain events, but drain back down into the catch basins as the water recedes downstream. This may <br />surprise some property owners, but with no permanent standing water in these areas, the wetland <br />setbacks do not apply. Clarification on compliance with the setbacks was also discussed for properties <br />that abut the delineated wetland. Property lines are outside of the “no-touch” buffer, and structure <br />setbacks are within drainage and utility easements. <br /> <br />The Commission unanimously recommended approval of the preliminary plat. <br /> <br />Development Agreement <br />The agreement follows our standard agreement and outlines required fees and security in the form of a <br />Letter of Credit and escrow deposits. The model home and building permit sections reflect Council <br />direction regarding the issuance of permits and utility installation timing.
