Parcel C was <br />to be adjoined to the applicant's adjacent property by means of a Subdivision <br />Exemption, however, the County does not allow a property to cross section <br />lines. Parcel C will be a separate property and owned by Richard Bury. <br /> <br />Minimum Lot Size <br /> <br />The Al district requires a minimum lot size of 10 acres or a density of 3 lots <br />per 30 acres. The applicant selected the density option. The 36.19 acre parcel <br />can be subdivided into three lots, with a minimum lot size of 2.5 acres. All <br />the lots will be legal and conforming to the Elk River Zoning Ordinance. <br /> <br />Access <br /> <br />Each parcel will have access to 221st Avenue and Parcel A will also have <br />access to Quinn. <br /> <br />DrainaI!e and Utility Easements <br /> <br />Typically, the City requires that 10 foot drainage and utility easements be <br />placed along the front and rear property lines, and 5 foot along the side <br />property lines and that they be granted to the City prior to recording with the <br />County. Since Parcels Band C are in the Mineral Extraction Overlay <br />District and are to be adjoined to adjacent mining land, 10 foot easements will <br />be required only along 221st Street NW. Parcel A is likely to be residential <br />and will be required to have a 10 foot easement along Quinn and 221st and a <br />5 foot easement along the north property line. The City Engineer is not <br />requiring drainage and utility easements along the City Trail as there is <br />adequate space for drainage there. <br /> <br />City Council MeetinI!. December 21.1998 <br /> <br />At the December 21, 1998, Public Hearing, residents Doug Gibson and Steve <br />Erickson challenged the validity of the survey provided by James R. Hill, <br />Inc. for the applicant. The residents claim that they own a 7 foot strip of land <br />between Quinn and the Bury property. Terry Maurer, the City Engineer, <br />studied the situation and maintains that the Bury Survey is valid regarding <br />this matter. <br /> <br />Also at the Public Hearing, the Bury Survey showed a discrepancy regarding <br />the City Trail location and the location described in Sherburne County <br />Document No. 236928. The easement location appeared to be misaligned <br />. with the actual trail location.
