THAT TEN FOOT DRAINAGE AND UTILITY EASEMENTS BE GRANTED TO THE CITY <br />ALONG 22lST AVE NW AND QUINN, AND A FIVE FOOT DRAINAGE AND UTILITY <br />EASEMENTS ALONG THE NORTH PROPERTY LINE OF PARCEL A. <br /> <br />2. THAT PAYMENT OF SURFACE WATER MANAGEMENT FEE IN THE AMOUNT OF <br />$137.50 FOR EACH OF THE TWO NEW LOTS BEING CREATED BE PAID PRIOR TO <br />RECORDING THE ADMINISTRATIVE SUBDIVISION. <br /> <br />COUNCILMEMBER FARBER SECONDED THE MOTION. THE MOTION CARRIED 4-1. <br />Mayor Klinzing, Councilmembers Thompson, Farber and Motin voted aye. <br />Councilmember Dietz voted nay. <br /> <br />6.7. Reauest bv Oakwood Development Co. for Final Plat Approval (Cherrvwood Hills <br />2nd Addition), P 99-1 <br /> <br />Planner Scott Harlicker informed the council of the request from Oakwood Land <br />Development for a final plat approval on Cherrywood Hills 2nd Addition <br />development to subdivide approximately 8.3 acres into 21 single family lots. Scott <br />indicated that the property is located west of Rush Street and east of Lafayette <br />Woods 2nd Addition. <br /> <br />e <br /> <br />Tom Mesich, Planning Commission member, stated that the Cherrywood Hills plat <br />had been sent back to the developer several.times in effort to save trees on the <br />lots. He stated that end result was that all trees were demolished and that the <br />Planning Commission is now working towards a "re-foresting" policy in attempt for <br />recourse involving the Commission motif plan. <br /> <br />Mayor Klinzing suggested the Sherburne County Tree Board as a possibility in <br />dealing with the motif effort. <br /> <br />COUNCILMEMBER THOMPSON MOVED TO APPROVE RESOLUTION NO. 99-7, <br />GRANTING FINAL PLAT APPROVAL FOR OAKWOOD LAND DEVELOPMENT'S <br />CHERRYWOOD HILLS 2ND ADDITION DEVELOPMENT TO SUBDIVIDE APPROXIMATELY <br />8.3 ACRES INTO 21 SINGLE FAMILY LOTS WITH THE FOLLOWING CONDITIONS: <br /> <br />1. A DEVELOPERS AGREEMENT OUTLINING THE TERMS AND CONDITIONS OF THE <br />PLAT APPROVAL AND NECESSARY IMPROVEMENTS BE PREPARED AND EXECUTED <br />PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />2. ALL THE COMMENTS OF THE CITY ENGINEER BE ADDRESSED. <br /> <br />3. A LETTER OF CREDIT IN THE AMOUNT OF 100% OF THE COST OF PUBLIC <br />IMPROVEMENTS BE PROVIDED PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />4. A SURETY BOND IN THE AMOUNT OF 25% BE PROVIDED TO THE CITY UPON <br />COMPLETING PUBLIC IMPROVEMENTS FOR A ONE YEAR PERIOD TO GUARANTEE <br />QUALITY OF WORK. <br /> <br />5. SURFACE WATER MANAGEMENT FEE IN THE AMOUNT OF $2,891.49 BE PAID PRIOR <br />TO RELEASING THE PLAT FOR RECORDING. <br /> <br />e <br /> <br />6. PARK DEDICATION FEE IN THE AMOUNT OF $13,650 BE PAID PRIOR TO RELEASING <br />THE PLAT FOR RECORDING. <br />
