SPECTRUM <br />HIGH SCHOOL <br />GRADES 6-12 <br />November 16, 2016 <br />17796 Industrial Circle NW, Elk River, MN 55330 <br />Phone: (&763) 241-8703 Fax: (763) 663-1380 <br />www. specturmhi ghschool.org <br />This information is being provided as supporting documentation for Spectrum High School's <br />Conditional Use Permit (CUP) application submitted on September 26, 2016. <br />Spectrum High School understands that a CUP is required to meet seven conditions in accordance with <br />Elk River Code of Ordinances Sec. 30-654 — Standards for issuance. We have attempted to address each <br />standard below. <br />Elk River Code of Ordinances Sec. 30-654 — Standards for issuance <br />(a) Required findings. The planning commission shall recommend a conditional use permit and the <br />council shall order the issuance of such a permit only if it finds that such use at the proposed location: <br />(1) Will not endanger, injure, or detrimentally affect the use and enjoyment of other property in the <br />immediate vicinity, or the public health, safety, morals, comfort, convenience, or general welfare of the <br />neighborhood or the city. <br />The CUP is to enable the expanded use of the building for a public school. Approximately 44% of the <br />building is already in use for this purpose. <br />While the original submittedplans outline afield house in the central area of the facility, bond market <br />fluctuation has required the school to downsize the scope of the project, eliminating plans for afield <br />house and performing arts center at this time. In order to plan for the necessary classroom space, the <br />downsized design provides for a slight extension of the interior NE corner as well as a second floor <br />above the northeast corner. The building is already designed to accommodate a second floor, including <br />second story windows and support options throughout. <br />The resulting plans also allow for the end unit 4121, owned by Robideau Properties, LLC, to remain <br />intact with full access to the front and rear of the condominium unit. <br />(2) Will be consistent with the comprehensive plan. <br />It is the school's understanding that the proposed use is consistent with the original CUP granted for <br />the school as well as the comprehensive plan. <br />(3) Will not impede the normal and orderly development and improvement of surrounding vacant <br />property. <br />The presence of the school will not materially impact the development of surrounding vacant property. <br />Spectrum High School has existed in this area for years without material negative impact on the <br />surrounding areas. <br />1IPage <br />
