<br />· Greene Espel for an amount not to exceed $300,000 for services provided and <br />expenses incurred in 2005 and to reduce the contract maximum for services <br />provided in 2004 by $100,000.00. <br />and authorize the Chair to finalize negotiations and execute the contracts and contract <br />amendments. The motion was seconded by Arne Engstrom and passed unanimously <br />on a voice vote. <br /> <br />Ms. Richardson noted that each contract has a termination clause which states that <br />work may be stopped with cause, without cause or with wind down of project and that <br />each contract may be terminated immediately. <br /> <br />7. Tim Yantos noted that as the Northstar Project moves forward into final design, work <br />on the project will be accomplished by the NPO. The NPO will work under the <br />direction of Tim Yantos, Executive Director, and Mark Fuhrmann, Project Director. <br />The NPO will be staffed by employees of the Mn/DOT and the Metropolitan Council, <br />as well as the Project Management Team of the NCDA. Mr. Yantos further noted that <br />the purpose of establishing the NPO is to meet the FTA's expectations for experience <br />and comprehensive project management and to create a cost-effective staffing <br />structure that builds on expertise gained in the construction of the Hiawatha Line. The <br />Metropolitan Council will provide the services of six employees working from 20 to <br />50% of their time on Northstar, Mn/DOT will provide the services of six employees <br />working from 60 to 83% of their time on Northstar. Payment for such services will be <br />made on an hourly basis. The total compensation for Metropolitan Council for 2005 <br />will be $372,000 and the total for Mn/DOT will be $209,000.00. Mr. Yantos noted that <br />funding for these services is included in the 2005 Amended Budget as approved by <br />the NCDA and the sources of funding is the NCDA and federal grant dollars. <br /> <br />David Elvig made a motion that the NCDA approve entering into a Cooperative <br />Agreement with Mn/DOT and the Metropolitan Council as described above, and <br />authorize the Chair to finalize negotiations and execute the agreement. The motion <br />was seconded by Art Daniels and passed unanimously on a voice vote. <br /> <br />8. Tim Yantos noted that Agenda Item #2f was pulled from the agenda because staff are <br />doing an internal investigation regarding the possibility that Anoka County may already <br />have a Broker/Insurance consultant on staff whom might be able to assist with <br />conducting an analysis of the risk exposures associated with the design, construction <br />and operation of the Northstar Commuter Rail Project and the options for the levels of <br />risk that should be retained and/or self-insured or, options and any potential <br />impediments to implementation of each option. Staff will keep the NCDA updated. <br /> <br />9. Tim Yantos gave an update on the progress being made with BNSF on negotiations. <br />Ken Stevens noted that a letter with BNSF's proposal should be received soon. <br /> <br />10. Mary Richardson reviewed the list of new House Committee Chairs. Tim Yantos noted <br />that the Northstar Project has received $5 million from the federal government as part <br />of the 2005 appropriations. <br /> <br />11, Todd Rapp noted that community involvement activities are gearing up for the 2005 <br />legislative session.
