Request by RJ Johnson on Behalf of Elk River Aerie # 3264 Fraternal Order of Eagles for <br />Conditional Use Permit for Private dub with On Sale Liquor. Public Hearing-Case No. <br />CU 04-35 <br /> <br />5.6.A Consider Cub and Sunday Liquor License for Fraternal Order of Eagles. Public Hearing <br /> <br />Senior Planner Scott Harlicker submitted the staff report. Mr. Harlicker stated the applicant <br />is requesting a Conditional Use Permit to operate a private club with an on sale liquor <br />license and is requesting a Cub and Sunday license. Mr. Harlicker discussed parking, utilities, <br />landscaping, signage, floor plan, and the Planning Conunission's recommendation. <br /> <br />Councilmember Motin questioned what the requirements are for a Cub liquor license. <br /> <br />Bart DiMaggio, 19339 180th Avenue, Big Lake-Stated the club is private for members only <br />but members can bring in guests. He stated if the same guests come more than three times <br />they must sign up to be a member if they want to come back again. <br /> <br />Mayor Klinzing opened the public hearing for the Conditional Use Permit and for the Cub <br />and Sunday license. There being no one to speak to this issue, Mayor Klinzing closed the <br />public hearing. <br /> <br />MOVED BY COUNOLMEMBER MOTIN AND SECONDED BY <br />COUNOLMEMBER TVEITE TO APPROVE A CONDITIONAL USE PERMIT <br />TO THE EAGLES CLUB TO OPERATE A PRIVATE CLUB AND ON SALE <br />LIQUOR ESTABLISHMENT BASED ON THE FOLLOWING CONDITIONS: <br /> <br />1. THE FREESTANDING SIGN ALONG 173RD SHALL BE REMOVED. <br /> <br />2. IF THE APPLICANT MODIFIES THE SIGN ALONG HIGHWAY 10, <br />OTHER THAN JUST CHANGING THE FACE, THE SIGN WILL HAVE TO <br />BE MOVED SO THAT IT COMPLIES WITH THE SETBACK <br />REQUIREMENT. <br /> <br />3. THE APPLICANT SHALL WORK WITH THE BUILDING AND FIRE <br />DEPARTMENTS WITH REGARD TO ALL BUILDING AND FIRE CODES. <br /> <br />4. A REVISED LANDSCAPE PLAN SHALL BE PROVIDED. AN <br />ADDITIONAL 10 TREES WILL BE REQUIRED. THE TREES SHALL BE <br />OVERSTORYTREES THAT COMPLY WITH THE LANDSCAPE <br />ORDINANCE. <br /> <br />5. THE APPLICANT SHALL APPLY FOR AN ON SALE LIQUOR LICENSE. <br /> <br />MOTION CARRIED 5-0. <br /> <br />MOVED BY COUNOLMEMBER MOTIN AND SECONDED BY <br />COUNOLMEMBER DIETZ TO APPROVE A CLUB AND A SUNDAY <br />LICENSE FOR THE EAGLES CLUB. MOTION CARRIED 5-0. <br />
