Request by KevinlKyleen Reiners for Ordinance Amendment Regarding Accessory- <br />Structure Size in A1 Zoning District. Public Hearing-Case No. OA 04-06 <br /> <br />Planner 01ris Leeseberg s\1bmitted the staff report. Mr. Leeseberg stated the applicant is <br />requesting an Ordinance Amendment for accessory structure sizes and for the number of <br />agricultural animals allowed per acre. He explained staff's support of the changes to <br />accessory sizes and stated the proposed increases are based on lot coverage. Mr. Leeseberg <br />stated the applicant would like to double the number of agricultural animals allowed in the <br />Rural Residential District provided a Manure Management Plan based on the Minnesota <br />Pollution Control Agency Technical Guidelines are followed and a Conditional Use Permit <br />(CUP) is obtained. <br /> <br />Mayor Klinzing opened the public hearing. There being no one to speak to this issue, Mayor <br />Klinzing closed the public hearing. <br /> <br />Councilmember Kuester expressed concern about allowing this type of facility near county <br />ditches due to the manure runoff that may possibly contaminate the water sources. <br /> <br />Ms. McPherson stated the MPCA guidelines and the CUP process are in place to have <br />conditions placed on the facility in order to protect the waterways. She stated it would be <br />enforced with periodic checks from staff and if there were any complaints from citizens. <br /> <br />MOVED BY COUNOLMEMBER TVEITE AND SECONDED BY <br />COUNOLMEMBER DIETZ TO ADOPT ORDINANCE 04-21 AMENDING <br />SECTIONS 30-793 AND 30-803 OF THE OTY CODE OF ORDINANCES <br />RELATING TO ACCESSORY BUILDINGS AND TO ANIMALS, CASE NO. OA <br />04-06. MOTION CARRIED 5-0. <br /> <br />5.5. Request by KevinlKyleen Reiners for Conditional Use Permit for NARHA Riding & <br />Equestrian Learning Center. Public Hearing-Case No. CD 04-34 <br /> <br />Planner 01ris Leeseberg submitted the staff report. Mr. Leeseberg stated the applicant is <br />proposing to operate an equestrian learning center to provide therapeutic horse riding to <br />children with disabilities. Mr. Leeseberg discussed the site layout, number of children at the <br />site, number of employees, and hours of operation. He also discussed parking, <br />environmental concerns, and the Planning Commission's recommendation. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />Bart DiMaggio, 19339 180th Avenue, Big Lake-Stated he is concerned about runoff if <br />storage of manure is allowed for a seven day period. <br /> <br />Mr. Leeseberg stated manure has to be stored on an impervious surface and must be <br />enclosed within sidewalls. <br /> <br />Joyce Mickelson, 14320 Ranch Road-Indicated to Council where the crop land would be <br />located. <br /> <br />Mayor Klinzing closed the public hearing. <br /> <br />Discussion was held on why the city ordinance requires pasture land when horses don't need <br />pasture land if they are kept in stalls or can be exercised on a trail. <br />
