A land swap agreement between the City of Elk River and Modem Construction will be <br /> drafted as part of the approval process. <br /> Engineering <br /> 8. Little detail has been provided relating to the street and utility extension being proposed. <br /> There is no project induded in the city Capital Improvement Plan to design or construct this <br /> utility and street extension as a public project.Authorization to construct the street will need <br /> to be authorized by the City Council. <br /> 9. 170`h Avenue will need to connect to the new Yale Street alignment. Stormwater management requirements are needed as listed in Ordinance Sec.78-503. - <br /> Stormwater and urban runoff control and Sec.78-504.-Post construction stormwater <br /> management.NPDES permit is needed for construction activity disturbing one acre or <br /> more of soil.Also,a MIDS water quality report and soil borings showing the ground water <br /> depth is needed.Three feet of separation between the bottom of any proposed stormwater <br /> basin and ground water is required. <br /> 14. In the city approved feasibility report for Yale Street—Street and Utility Improvements <br /> (July 28,2014)identifies a need to extend the existing stormwater pond south to <br /> accommodate runoff from the Yale Street extension.The current stormwater pond treats <br /> runoff from the city streets between 173'd Street and the south end of Yale Court.The city's <br /> ability to expand the existing pond must be maintained,and deviation from the 2014 plan <br /> will need authorization from the City Council. <br /> Fire Department <br /> 15. Fire department access has not been satisfied with the initial plan. Section 503 of the MN <br /> State Fire Code states that an access road shall be provided for all buildings. <br />
