information in the disclosure portion of the listing agreement so he <br />asked the City Planner the status of the ROW on York Ave and also if <br />the City had any plans to improve that portion of York Ave. as the <br />black top was in disrepair and needed to be replaced. The City Planners <br />answer was that the city did not have any plans to make any <br />improvements on that piece of land but that we could continue to use it <br />as we had in the past. <br />Based on that and the fact that the black top was in bad shape I <br />contacted an asphalt company and spent approximately $5,000 to have <br />the old asphalt completely removed and new asphalt installed. We then <br />listed our home and had the largest open house our agent has ever had. <br />Unfortunately, the issue of access has come up again with someone <br />wanting the City to reopen York Ave. as a boat launch and add a dock all <br />of which adjacent property owners do not want. We had several very <br />interested prospects for our home but they have moved on because of <br />their concern for what may happen to the ROW approximately 30 feet <br />outside the front door of our home. Due to the inaction of prior City <br />Councils this land has never provided any tax revenue to the City of Elk <br />River, it also has not been serving any public purpose for over 40 years <br />and it would be in the best interests of the public to vacate said <br />portion of York Ave. I do not understand why the Elk River City Council <br />is so concerned with holding on to a 66 foot wide ROW in the middle of <br />a residential area when the City already has a beautiful 28 acre park <br />with a swimming beach over 2,700 feet of shoreline, a fishing pier, a <br />boat launch, dock, picnic tables. shelters and plenty of parking available <br />to satisfied all the needs of the citizens of Elk River. I, my wife Paula <br />our neighbor Jim Burgoyne and more than 150 other citizens of Elk <br />River (as of Dec 28, 2015) request that the city council do the right <br />thing and vacate that portion of York Ave. north of Main 5t. <br />Thank you for your time and consideration in this manner. <br />Respectfully <br />Ron Dargis <br />
