Elk River to spend our winter in Florida. The EIK River City Council was <br />to hold the hearing for our vacation request on January 17 2006. I <br />called my City Council Representative in January, prior to the meeting <br />and asked if I should fly back to be present for the meeting. I was told <br />that it shouldn't be a problem and that he was familiar with what we <br />wanted. At the City Council meeting on January 17 2006 the Senior <br />City Planner Scott Harlicker, and Parks and Pec Director Bill Maertz <br />recommended to the City Council not to grant our request to vacate. <br />Council member Motin asked Scott Harlicker if the access on Xenia <br />Ave and Watson Ave had ever been vacated. Scott Harlicker then gave <br />the City Council total misinformation. He told the council that Xenia <br />and Watson Ave had not been vacated (when in fact they had been <br />vacated). Council member Farber then suggested, to remain consistent <br />and not set a precedent by vacating that portion of York Ave. our <br />application for vaction should be denied. This specific information was <br />never provided to me by my Council Representative, He told me by <br />phone that the City Planner and the Parks and Rec Director <br />recommended that the council deny our request and that several of my <br />neighbors were also at the meeting and requested that the council not <br />vacate that portion of York Ave. In doing research for my current <br />application I found that also was not totally true. The minutes from the <br />Council meeting on Janurary 17 2006 state that two of my neighbors <br />spoke, one of my neighbors was concerned only that I not be allowed to <br />build on that land because it could spoil his view to the lake and the <br />other neighbor wanted to be able to use it for canoe access. Access <br />was already not allowed by City Council action dating back to 1975 when <br />access was closed to the launching of boats. I also found in those <br />Council minutes the misinformation given by Scott Harlicker to the <br />Council about the ROW's on Xenia and Watson Ave. The fact is 3 <br />access, Xenia, Watson and Vine St had all been vacated_ This summer <br />my wife and I considered putting our home on the market and <br />contacted a local real estate agent. The agent wanted to know the <br />status of the ROW on York Ave. He wanted to provide the correct <br />
