.1-23070 <br />STATE OF MINNESOTA <br />VILLAGE OF ELK RIVER <br />COUNTY OF SHERBURNE " <br />4 <br />RESOLUTION BY VILLAGE COUNCIL VACATING STREET <br />In the Matter of the Vacation°of that part of Walnut Streetm <br />(new Xenia Avenue) Ding between Ebcks 3: and 4, in Orono, <br />between ,the Northerlyt4ine of Main Street and Lake'Orono. <br />6 <br />The above entitled matter came on to 'be heard before the Village <br />Council -of the Village of Elk River, Sherburne County, Minnesota, <br />upon the petition of Howard Wirtz and Viola Wirtz, his wife, and <br />James D. Thomas and Loretta Thomas, his wife, for the vacation of <br />a portion of Walnut Street in Orono therein described- and the Vil- <br />lage Council having given due notice of said heari.pg by published <br />and poaed'btice as provided by law and said hearing having been <br />held on the 21st day of 1973, at 6.00 o'clock P.M. <br />at the Council Charlbers in lage p and no orae apl5eared to <br />opposition thereto, and the said Council after heaWing the evidence <br />presenthd to it In favor of said petition finds: That petitioners <br />are the owners of all the land abutting said portion of Walnut <br />Street sought to be vacated; that said portion of Walnut Street is <br />not serving*any public purpose, and that it would be in the best <br />interests of the public to vacate said portion of Walnut Street; <br />Councilman Clifford Lundberg; introduced the following <br />resolution, to -wit: <br />That portion of Walnut Street (now Xenia Avenue)lying between <br />Blocks 3 and 4, in Orono, between the Northerly line of Main <br />Street and Lake Orono, be and the same hereby is.vacated. <br />Which resolution was seconded by Councilman Tom Hudson <br />and being put to a vote a majority of said Council vote rn tavor <br />of said resolution, whereupon said resolution was declared adopted <br />by the Mayor of said Village.
