Ms. McPherson noted that <br /> the zone change from R3 to PUD is needed because the R3 zoning classification <br /> does not address the issues of common areas and private streets. <br /> <br />Mayor Klinzing opened the public hearing. <br /> <br />Jim Filipovich, 801 Line Avenue, expressed concerns about growth and how more <br />development will impact the Elk River School District. Mr. Filipovich stated <br />concerns regarding trees, screening, assessments, and the trail being too close (3- <br />4 feet) to his driveway. <br /> <br />Ms. McPherson stated that staff would work with Mr. Filipovich on the screening <br />and trail issues. Mayor Klinzing stated that there would not be any assessments to <br />Mr. Filipovich regarding the trail or this development. <br /> <br />Brian Doric, 544 Auburn Place, stated concerns about this development lowering <br />property values in the area. <br /> <br />City Attorney Peter Beck stated that Mr. Doric could check with the county in <br />regards to how this may affect his property values. <br /> <br />Mayor Klinzing closed the public hearing. <br /> <br />Councilmember Dietz questioned how this development is affected if the city <br />decides to cul-de-sac County Road 13. Councilmember Matin also commented <br />that County Road 13 could be put into a cul-de-sac when 193rd goes through to <br />Tyler Street. Councilmember Dietz noted concerns regarding the street widths <br />and getting the message to future residents that these would not be city streets <br />and the city would not be responsible for maintenance and plowing. <br /> <br />Councilmember Farber noted his concern about the limited number of accesses <br />in and out of the development. <br /> <br />Mayor Klinzing stated concerns over the impact of continued growth in the Elk <br />River School District. <br /> <br />Director of Planning Michele McPherson noted that the preliminary plat calls for <br />two cul-de-sacs and that this may change in the final plat. The final plat issue <br />tonight is only for the western pad of the site. She further requested that another <br />condition be added to the preliminary plat and the conditional use permit stating <br />that Phase II of the development be contingent upon the developer obtaining <br />the appropriate wetland approvals. <br /> <br />COUNClLMEMBER FARBER MOVE TO ADOPT ORDINANCE NO. 00-14 REZONING <br />CERTAIN PROPERTY TO PUD (PLANNED UNIT DEVELOPMENT) FROM R3 <br />(TOWNHOUSE/MULTIFAMILY RESIDENTIAL) BASED ON THE FOLLOWING FINDINGS OF <br />FACT: <br /> <br />1. THAT THE REZONING IS CONSISTENT WITH THE CITY'S COMPREHENSIVE PLAN. <br /> <br />2. THAT THE REZONING WILL NOT CREATE ADVERSE IMPACTS TO ADJACENT USES. <br /> <br /> <br />
