Elk River City Council Meeting Page 11 <br />June 19, 2000 <br /> <br />Mayor Klinzing opened the public hearings. There being no one for or against the <br />ma~ers, Mayor Klinzing closed the public hearing. <br /> <br />COUNC:ILMEMBER FARBER MOVED TO ADOPT ORDINANC:E 00-11 AMENDING THE <br />CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN PROPERTY FROM BUSINESS <br />PARK TO C3 (HIGHWAY COMMERCIAL), CASE NO. ZC 00-4, BASED ON THE <br />FOLLOWING FINDINGS: <br /> <br />THE REZONING IS CONSISTENT WITH THE COMPREHENSIVE LAND USE PLAN <br />DESINGATION OF HB (HIGHWAY BUSINESS). <br /> <br />THE CONDITIONS HAVE CHANGED TO WARRANT THE DEVELOPMENT OF THIS <br />PARCEL AS HIGHWAY COMMERCIAL. <br /> <br />THE PROPERTY IS ADJACENT TO HIGHWAY 10 AND IS LOCATED NEAR A <br />SIGNALIZED INTERSECTION THAT WILL MEET THE TRANSPORTATION NEEDS OF <br />BUSINESS ALLOWED UNDER THE C:3 ZONING DISTRICT. <br /> <br />THE C3 ZONING DISTRICT IS COMPATIBLE WITH THE ADJACENT ZONING <br />DISTRICTS. <br /> <br />THE PROPERTY IS WITHIN THE URBAN SERVICE AREA AND WILL BE SERVICED <br />BY MUNICIPAL SEWER AND WATER. <br /> <br />COUNCILMEMBER MOTIN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />C:OUNCILMEMBER FARBER MOVED TO ADOPT RESOLUTION 00-46 AMENDING THE <br />COMPREHENSIVE PLAN TO CHANGE THE LAND USE FROM LI (LIGHT INDUSTRIAL) TO <br />HB (HIGHWAY BUSINESS), CASE NO. LU 00-4 BASED ON THE FOLLOWING FINDINGS: <br /> <br />THE PARCEL WAS IDENTIFIED IN THE COMPREHENSIVE PLAN AS A FUTURE <br />AREA FOR COMMERCIAL LAND USES. <br /> <br />2. THE PARCEL UNDER CONSTRUCTION IS ADJACENT TO HIGHWAY 10. <br /> <br />THE PROPOSED LAND USE PLAN AMENDMENT WILL ALLOW FOR HIGHWAY <br />COMMERCIAL DEVELOPMENT AT A SIGNALIZED INTERSECTION. <br /> <br />COUNCILMEMBER MOTIN SECONDED THE MOTION. THE MOTION CARRIED 4-0. <br /> <br />6.11. <br /> <br />Reconsider Requests LU 00-2 and ZC 00-2 by Hoyt Partners <br /> <br />Director of Planning Michele McPherson indicated that staff is recommending to <br />amend two motions pertaining to the rezoning and land use of parcels located in <br />Elk Path Center from the March 20, 2000, City Council meeting. She explained <br />that staff and Planning Commission are recommending that Parcel 3 remain <br />business park zoning as Parcel 3 was not intended to be zoned commercial. <br /> <br />COUNCILMEMBER THOMPSON MOVED TO RECONSIDER THE TWO MOTIONS MADE <br />ON MARCH 20, 2000, PERTAINING TO THE ZONE CHANGE AND LAND USE FOR HOYT <br /> <br /> <br />
