Planning Commission Minutes Page 2 <br />July 14, 2015 <br />5.2 Request by the City of Elk River Elk River for Ordinance Amendments <br />related to Extreme Commercial Recreation, Case No. OA 15 -07: <br />5.2a Section 30 -1— Definitions <br />5.2b Section 30 -880 — Extreme Commercial Recreation <br />5.2c Section 30 -1041— Principal Structures <br />5.2d Section 30 -1042 — Accessory Structure Setbacks <br />Chris Leeseberg presented the staff reports for Items 5.1a -5.1e. <br />Chair Johnson asked for clarification on roadside stands. Mr. Leeseberg stated that roadside <br />stands typically sell farm products such as fruits and vegetables, or other seasonal items. He <br />noted that this use is an interim use in the current ordinance for this zoning district. Chair <br />Johnson asked if staff has considered food trucks as a use. Mr. Leeseberg stated yes, but <br />that they are currently looking at the issue of food trucks in all zoning districts, including this <br />one. <br />Chair Johnson asked if the applicant had issues with any of the proposed conditions. The <br />applicant indicated "no ". <br />Mr. Leeseberg presented the staff reports for 5.2a — 5.2d. <br />Chair Johnson opened the public hearing. There being no one to speak to this issue, Chair <br />Johnson closed the public hearing. <br />Motion by Commissioner Johnson and seconded by Commissioner Larson -Vito to <br />recommend approval of an Ordinance Amendment to add a new extreme <br />commercial recreational zoning district, Case No. OA 15 -04. Motion carried 5 -0. <br />Motion by Commissioner Larson -Vito and seconded by Commissioner Johnson to <br />recommend approval of a Land Use Amendment to change the land use of the <br />property described from Development Reserve /Mining /Residential to Highway <br />Business /Mining, Case No. LU 15- 03. Motion carried 5 -0. <br />Motion by Commissioner Larson -Vito and seconded by Commissioner Johnson to <br />recommend approval of a Zone Change from CRT (Commercial Reserve Transition) <br />to XCR (Extreme Commercial Recreation), Case No. ZC 15 -06. <br />Motion by Commissioner Johnson and seconded by Commissioner Christianson to <br />recommend approval of the Preliminary Plat of Aggregate Commercial Third <br />Addition, Case No. P 15 -05, with the following conditions: <br />1. Surface water management fee be paid in the amount required by the city <br />(currently $1,287 /acre)prior to releasing the Final Plat for recording. <br />2. A development plan shall be approved by the city engineer prior to the <br />issuance of building permits. <br />3. A wetland delineation report must be completed and accepted by the city. <br />4. A 45 foot easement around all wetlands shall be added to the Preliminary Plat. <br />
