Planning Commission Minutes Page 4 <br />April 28, 2015 <br />The staff report was presented by Zack Carlton. The applicant re <br />Conditional Use Permit to allow a 42,000 sq. ft. facility for truck sales and service at 10743 <br />168th Circle NW. <br />Chair Johnson opened the public hearing for the zone change. <br />Tim Dolan, Decklan Group, stated that he represented the applicant. He noted that only <br />one of the lots needs to be rezoned. He stated that the applicant is in agreement with staffÔs <br />comments and is willing to work with them on addressing the conditions. <br /> <br />There being no further comments from the public, Chair Johnson c <br /> <br />Chair Johnson stated that he did not see a reason to not approve the rezoning and felt the <br />use would go well with the existing uses and new businesses bein <br />Motion by Commissioner Johnson and seconded by Commissioner Thei <br />recommend approval of the request by GATR Truck Center for a zone change from <br />Business Park to Highway Commercial, Case No. ZC 15-03. Motion carried 5-0. <br /> <br />Chair Johnson opened the public hearing for the Conditional Use Permit request by GATR <br />Truck Center. There being no comment from the public, Chair Joh <br />hearing. <br />Motion by Commissioner Johnson and seconded by Commissioner Larson-Vito to <br />recommend approval of the request by GATR Truck Center for a Conditional Use <br />Permit for truck sales and service, Case No. CU 15-09, with the following conditions: <br /> <br />1.As a Conditional Use Permit is not a building permit, all necessary permits must <br />be acquired before any work begins. <br />2.Remove outdoor storage area identified on the site plan. <br />3.Pave the trailer parking area east of the facility with bituminous pavement. <br />4.Address all comments in the staff comment letter dated April 17, 2015. <br /> <br />Motion carried 5-0. <br /> <br />4.4 Request by City of Elk River for Ordinance Amendment for accessory <br />structure permits, Case No. OA 15-03 Ï Public Hearing <br /> <br />Zack Carlton explained that the ordinance amendment would increase the minimum <br />accessory structure size requiring a building permit from 120 sq. ft. to 200 sq. ft. Also, the <br />amendment would eliminate the size requirement for compliance with minimum setbacks <br />and specific material standards and include all accessory struct <br />building official is interested in adding a land use application <br />structures, even if less than 200 sq. ft. <br /> <br />
