Memo to Mayor and City Council/Right of Way Ordinance <br />April 14, 2000 <br />Page 2 <br /> <br />However, in recent months, with the advent of deregulation of many utilities, more and <br />more subcontractors have been working in the City without proper permits. In addition, <br />the current process does not have one department as a "clearinghouse" for permits. <br />Both the Public Works Department and the Building Department currently accept <br />permits, which makes communication and oversight difficult. <br /> <br />The current ordinance does not clearly establish the City's standards for working in the <br />right-of-way. The new ordinance clearly states the application requirements and the <br />expectation that the right-of-way will be restored to the City's standard. <br /> <br />Many other communities are adopting the League's ordinance, thereby providing <br />consistency between jurisdictions in how rights-of-way are managed. <br /> <br />A summary resolution is also attached for publication purposes. <br /> <br />Recommendation <br /> <br />Staff recommends that the City Council approve the attached ordinance and summary <br />resolution. The summary resolution will be published in place of the entire ordinance. <br /> <br /> <br />
