In 1997, the
Minnesota Legislature adopted Chapter 123, telecommunications right of way
legislation.

Since adoption of Chapter 123, the League of Minnesota Cities and the City Engineers
Association of Minnesota have been working cooperatively to draft a model ordinance
for the regulation of utilities in municipal rights-of-way. The proposed ordinance is the
short form version.

Analysis

The City currently requires street disruption permits and processes requests for
installation of utilities in the right-of-way. Many of the larger utilities have been
cooperative in obtaining permits and notifying staff when projects are ongoing.

13065 Orono Parkway · P.O.
