WATER ACCESSIBILTY FEES IN THE AMOUNT DETERMINED BY THE cITY BE PAID PRIOR <br /> TO RELEASING THE PLAT FOR RECORDING. <br /> <br /> 20. ANY ITEM OR CONDITION FOUND THAT INDICATES THE SITE IS LIKELY TO YIELD <br /> INFORMATION IMPORTANT TO PRE-HISTORY OR HISTORY SHALL BE REPORTED TO THE <br /> CITY IMMEDIATELY. NO GRADING, EXCEPT FOR THE CUL DE SAC, SHALL BE ALLOWED IN THE WOODED <br /> AREA OF OUTLOT A <br /> <br /> 22. THE DEVELOPER SHALL WORK WITH THE CITY ON AN OAK WILT SUPPREESION <br /> PROGRAM. THIS PROGRAM SHALL BE APPROVED AND IN PLACE PRIOR TO ANY TREE <br /> REMOVAL. <br /> <br />23. OUTLOT G BE COMBINED WITH LOTS 3 AND 4, BLOCK 4 <br /> <br />24. OUTLOT C BE ELIMINATED. <br /> <br />Should the Council deny the preliminary plat, the Council should consider basing that <br />decision of the following findings: <br /> <br />The physical characteristics of the site, including but not limited to <br />topography, soils, vegetation, susceptibility to erosion and siltation, <br />susceptibility to flooding, and drainage are not suitable for the type and <br />density of development and uses contemplated. <br /> <br />This area has been identified on the Minnesota County Biological Survey <br />Map of Sherbume County as one of the last remaining mature samples of <br />deciduous dry oak forests in Elk River. Because of the amount of grading <br />required and the large number of mature trees that will be removed, the <br />proposed subdivision will cause substantial environmental damage <br /> <br />An option the Council could consider should the plat be denied is to ask the applicant to <br />come back with a plat with the same number of lots but clustered on the west side of the <br />plat.
