Background/Discussion <br /> The applicant is leasing a portion of the subject property and building for trailer sales/repair and auto <br /> sales. The subject property is currently zoned C3 (Highway Commercial) and has an underlying Land Use <br /> of High Density Housing/Riverfront Amenity (The Point) as defined in the adopted Comprehensive Plan <br /> and the Focused Area Study (FAST). If approved, the Interim Use Permit will apply to the entire <br /> property. <br /> Planning Commission meeting summary <br /> The Planning Commission reviewed this request as a Conditional Use Permit and discussed the history of <br /> the building, traffic, and the Land Use. <br /> The Planning Commission recommended denial of the Conditional Use Permit by a 4-1 vote based on <br /> the following reasons: <br /> 1. The project is not consistent with the comprehensive plan. The subject property has an <br /> underlying Land Use of High Density Housing/Riverfront Amenity (The Point) as defined in the <br /> adopted Comprehensive Plan and the Focused Area Study (FAST). The uses here would include <br /> residential product from townhomes to apartments and uses that embrace the river. <br /> 2. A non-conforming land use could impede the normal and orderly development of the surrounding <br /> vacant properties. <br /> 3. The project is not adequately served by the available city water and sewer services. <br /> Additional information <br /> Since the Planning Commission meeting, the applicant has requested the Conditional Use Permit become <br /> an Interim Use Permit and is asking that the Interim Use Permit expire on May 1, 2015. This is a result <br /> of the pending sale of the subject property to another business. In order to bring the property into code <br /> compliance, staff is suggesting a condition that would require the applicant to reapply for a Conditional <br /> Use Permit should the pending sale fall through. <br /> Financial Impact <br /> None <br /> Attachments <br /> • Planning Commission Memo dated February 24, 2015 <br /> • Email from applicant requesting the Conditional Use Permit become an Interim Use Permit <br />
