LU 04- <br />01. <br /> <br />MOTION CARRIED 4-0. <br /> <br />MOVED BY COUNCILMEMBER DIETZ AND SECONDED BY <br />COUNCILMEMBER TVEITE TO ADOPT ORDINANCE 04-07 AMENDING <br />THE CITY OF ELK RIVER ZONING MAP TO REZONE CERTAIN <br />PROPERTIES FROM R1C (SINGLE FAMILY RESIDENTIAL) TO PUD <br />(PLANNED UNIT DEVELOPMENT), CASE NO. ZC 04-02. <br /> <br />MOTION CARRIED 4-0. <br /> <br />MOVED BY COUNCILMEMBER TVEITE AND SECONDED BY <br />COUNCILMEMBER KUESTER TO APPROVE THE CONDITIONAL USE <br />PERMIT FOR MENARDS WITH THE FOLLOWING CONDITIONS: <br /> <br />1. ALL COMMENTS OF THE CITY ENGINEER BE ADDRESSED. <br /> <br />2. THE PLANNED UNIT DEVELOPMENT AGREEMENT BE <br /> AMENDED TO REFLECT THE AMENDED PUD. <br /> <br />3. A 50 FOOT WIDE LANDSCAPED BUFFER BE PRESERVED ALONG <br /> DODGE STREET. <br /> <br />4. NO OUTSIDE LOUDSPEAKERS ARE ALLOWED. <br /> <br />o <br /> <br />NO STORAGE OR DISPLAY OF MATERIAL OR GOODS ASSOCIATED <br />WITH THE GARDEN CENTER SHALL OCCUR OUTSIDE OF THE <br />GARDEN CENTER. <br /> <br />6. A 20 FOOT WIDE DRIVE AISLE SHALL BE MAINTAINED AROUND <br /> THE BUILDING. <br /> <br />ANY ITEM OR CONDITION FOUND THAT INDICATES THE SITE IS <br />LIKELY TO YIELD INFORMATION IMPORTANT TO PRE-HISTORY <br />OR HISTORY SHALL BE REPORTED TO THE CITY IMMEDIATELY. <br />FURTHER, THE CITY RESERVES THE RIGHT TO STOP WORK <br />AUTHORIZED IN ITS APPROVAL UNTIL THE SITE IS <br />APPROPRIATELY INVESTIGATED AND WORK IS AUTHORIZED TO <br />CONTINUE BY THE CITY. <br /> <br />8. STORAGE OF MATERIALS OR PLACEMENT OF RACK SYSTEMS <br /> SHALL NOT IMPEDE EMERGENCY ACCESS. <br /> <br /> <br />
