Should an access drive onto 217th Avenue be created at any time, the portion of <br /> • 217th Avenue from County Road 1 to fifty feet past the access drive shall be paved <br /> to city standards. <br /> The motion carried 5-0. <br /> 5.3 Request by Benzinger Properties, Inc. for Preliminary Plat approval <br /> (Prestigious Woodland Hills Second Addition), Case No. P 14-04 — Public <br /> Hearing <br /> Planner Zack Carlton's staff report was presented by Chris Leeseberg. Staff recommended <br /> approval with the 10 conditions listed in the report. <br /> Chair Johnson opened the public hearing. <br /> Jeff Benninger, applicant— stated that the site is already graded out. He stated that he hopes <br /> to build out the remaining lots to finish off the development as soon as possible. <br /> There being no public comment, Chair Johnson closed the public hearing. <br /> Motion by Commissioner Jeremy Johnson and seconded by Commissioner Keller to <br /> recommend approval of the request by Benzinger Properties, Inc. for Preliminary <br /> Plat approval for Prestigious Woodland Hills Second Addition,with the following <br /> • conditions: <br /> 1. A developers agreement shall be prepared and executed outlining the terms and <br /> conditions of the plat approval prior to releasing the plat for recording. <br /> 2. Surface water management fee shall be paid in the amount required by the city at <br /> the time of final plat prior to releasing the plat for recording. (currently <br /> $214/residential lot) <br /> 3. All comments in the letter from the city planner dated April 23, 2014, shall be <br /> addressed and incorporated into the plans. <br /> 4. Street lights shall be installed as required by Elk River Utilities. <br /> 5. A Letter of Credit shall be provided to the city in the amount of 100% of the costs <br /> of the public improvements. <br /> 6. Upon completing all of the improvements and having them accepted by the city, <br /> a security or warranty in a form acceptable to the city engineer will be secured. <br /> 7. A sealcoat fee in the amount to be determined by the city engineer shall be paid <br /> prior to releasing the plat for recording. (currently $5/foot) <br /> 8. A development plan shall be approved by the city engineer prior to the issuance <br /> of building permits. <br /> 9. All mailboxes shall be clustered. <br /> 10. Any item or condition found that indicates the site is likely to yield information <br /> important to pre-history or history shall be reported to the city immediately. <br /> Further, the city reserves the right to stop work authorized in its approval until <br /> the site is appropriately investigated and work is authorized. <br /> • The motion carried 5-0. <br />
