Mr. Harlicker stated that Eik lever <br />Station, LLC is requesting final plat approval for Elk River Station 2nd Addition. He stated <br />that the project is a mixed use development that includes townhomes, apartments, <br />commercial/office space, and senior housing. He discussed street and lot layout, number of <br />units, and Park and Recreation Commission action. <br /> <br />Councilmember Modn questioned Mr. Maurer's comment in his staff report regarding the <br />narrow easement running along a storm sewer line. Nix. Maurer stated that he informed the <br />applicant of this narrow easement but that the city can't enforce the easement as it is a <br />private storm sexver running along a private roadway. <br /> <br />Councilmember Tveite stated that he would Like a condition added to the developer's <br />agreement that informs future residents that the cul-de-sac placed on the northeast end of <br />172~a Avenue will be tempora~.'y and the road xvill be continued at some point in the future. <br /> <br />MOVED BY COUNCILMEMBER TVEITE AND SECONDED BY <br />COUNCILMEMBER KUESTER TO ADOPT RESOLUTION 04-06 GRANTING <br />FINAL PLAT APPROVAL FOR ELK RIVER STATION 2N~) ADDITION, CASE <br />NO. P 03-18 WITH THE FOLLOWING CONDITIONS: <br /> <br />A DEVELOPERS AGREEMENT BE PREPARED AND EXECUTED <br />OUTLINING THE TERMS AND CONDITIONS OF THE PLAT <br />APPROVAL AND INSTALLATION OF IMPROVEMENTS PRIOR TO <br />RELEASING THE PLAT FOR RECORDING. <br /> <br />2. A LETTER OF CREDIT BE PROVIDED TO THE CITY IN THE <br /> AMOUNT OF 100% OF THE COSTS OF PUBLIC IMPROVEMENTS. <br /> <br />UPON COMPLETING ALL OF THE IMPROVEMENTS AND HAVING <br />THEM ACCEPTED BY THE CITY, A WARRANTY BOND IN THE <br />AMOUNT OF 25% OF THE IMPROVEMENT COSTS SHALL BE <br />SUBMITTED TO THE CITY FOR A ONE YEAR PERIOD. <br /> <br />SURFACE WATER MANAGEMENT FEE IN THE AMOUNT <br />REQUIRED BY THE CITY AT THE TIME OF FINAL PLAT BE PAID <br />PRIOR TO RELEASING THE PLAT FOR RECORDING. <br /> <br />o <br /> <br />SEALCOAT FEE IN THE AMOUNT TO BE DETERMINED BY THE <br />CITY ENGINEER BE PAID TO THE CITY PRIOR TO RELEASING <br />THE PLAT FOR RECORDING. <br /> <br />6.
