Barnhart, Jeremy
From: Barnhart,Jeremy
Sent: Monday,April 21,2014 3:16 PM
To: Barnhart,Jeremy
Subject: FVV: Playground Equipment
From: ]
Sent. Friday,June 0G, 2012 10:12 AM
To: Pmrtner, Cal
Subject: Re: FW: Playground Equipment
HiCa|-
I guess I'm missing the point of John Dufy'sresponse.
When he says"Our site has thoroughly screened and documented every adult and child im our deve|opmnmmt^^'ishetalking
just about the Depot apartment building the entire Elk River Station Development. ( seem to remember hewas
involved with the development of all oY Elk River Station. He clearly is NOT documenting every adult and child in the Elk
River Station development since most of the townhouses are individually owned and many uf them are rented out(| for
one anm living there with rny younger daughter, I'm sure we were not screened or documented byJohn's company for
approval). Even as to the Depot apartment building, I'm sure his company is not screening and documenting guests or
others the tenants are not telling him about.
But assuming John |n just talking about the Depot site ... there was nothing io Ms. Kmnnpa'semail that suggested that
people from the rest uf Elk River Station (or from outside the area)were going into the Depot site h» use its playground
area orthat suggested that the Depot playground equipment was somehow deficient. She was talking about Depot
residents (as well aa others) using the playground in the townhornmdevelopment.
John's response seems 0o focus primarily onthe quality ofthe playground equipment and how well screened and
monitored the residents supposedly are. Again, | don't think those are being questioned.
Udo not know what the agreement about shehngofamenities is between Elk River Station townhomea. Pullman Place,
the Depot, and the (pnssib|e)apartment building mobebuilt. | assume that each of the playgrounds bm used 6y all the
residents )m the area. | advised Ms. Kampa that it is not a City issue whether the Depot residents are using a non-Depot
playground. |, myself, thought it was allowed. |f the Depot residents are not supposed touse the other playground, that im
am Association issue.
But John also comments that the problem may be children that come in who don't live at the site. He even comments that
"Our general philosophy has been that children will play where their friends are. Clearly our residents have many
friends," | completely share that philosophy children will (and should) play where their friends are ... and l want them bz
have a lot uf friends. And THAT is precisely why Iomso against a 60 unit apartment building being built nnthe west side
ofTvvnLakenRoad -ourroundedbytMoRoadamdyhotraimdepotamdpadkimg.
The apartment building will be situated ona mere two acres, And, yes, | don't doubt it will have a very nice
playground. But the kids in that building will betrapped. Most kids du not play in playgrounds(at least after they are
about 8 years old)[admittedly, I am only guessing at that age, but from experience, I doubt I'm too far off.] They will wind
up hanging around the train tracks and depot parking area (not a safe alternative)or, more likely, as John said-"the
children will play where their friends are." The children in the new building will have a lot of friends in the rest qf the Elk
River Station development(not to mention Park Point Trout Brook Farms, etc. that are within a short bike ride). Instead
ofa mere 2 acres, the rest of the Elk River Station development itself is over a hundred acres, with wetlands and
playgrounds, Instead offriends from a mere G0 units, there will be friends from hundreds cfunits across the street(and
thousands in the area), There is no doubt in my mind that the children [I'm not talking about the supervised young
children using the playground, but the majority that won't be]will want to play with friends who don't live in the
building. And that's the problem. |o the legal field, that's what we refer tmasen "attractive nuhsonce." There imnosafe
reasonable way for children to get from one side of Twin Lakes Road to the other. The only intersection is at the
1
