Memo to Mayor and City Council/Morcon <br />February 9, 2004 <br />Page 9 <br /> <br />Staff recommends the Council adopt Resolution No. 04- approving the request to <br />amend the Land Use Plan for the subject property from Medium Density Residential to <br />Highway Business, based on the following findings <br /> <br />· The conditions have changed to warrant a change in the land use. A traffic light has <br /> been installed at the 197~h Avenue/Highway 169 intersection. Previously vacant <br /> highway commercial land has been developed. <br />· There are no other highway commerdal opportunities along the Highway 169 <br /> corridor of substantial size to adequately compete with adjacent surrounding <br /> communities' commerdal sites. <br /> <br />Staff recommends the Council approve Ordinance No. 04- rezoning the properties <br />from Single-Family Residential to Planned Unit Development, based on the following <br />findings: <br /> <br />· The proposed rezoning to PUD is consistent the land use designation of Highway <br /> Business. <br /> <br />The times and conditions have changed to warrant the change in zoning to PUD. A <br />traffic light has been installed at the 197~h Avenue/Highway 169 intersection. There <br />are no other highway commercial opporumities along the Highway 169 corridor of <br />substantial size to adequately compete with adjacent surrounding communities' <br />commercial sites. <br /> <br />Utilities can be extended to the site without requiring the non-sewered <br />neighborhoods of Ridgewood East 3rd and Brentwood to hook up to the same. <br /> <br />The subject property has good highway visibility and, with a frontage road through <br />the development, could see traffic impacts to the Brentwood neighborhood reduced. <br />The design of the PUD, as well as the vegetation to be preserved and proposed <br />screening, will reduce the impact on neighboring residences. <br /> <br />Staff also recommends that the City Council approve the conditional use permit for Elk <br />Ridge Center Planned Unit Development based on the findings that the proposed project: <br /> <br />(1) Will not endanger, injure or detrimentally affect the use and enjoyment of other <br />property in the immediate vicinity or the public health, safety, morals, comfort, convenience <br />or general welfare of the neighborhood or the city. <br /> <br />(2) Will be consistent with the comprehensive plan. <br /> <br />(3) Will not impede the normal and orderly development and improvement of <br />surrounding vacant property. <br /> <br />S:kPLANNING\Case Files\2003\P 03-16 Elk Ridge CenterkP03-16CC2-9.doc <br /> <br /> <br />
