Memo to the Planning Commission/Development Moratorium <br /> November 25,2003 <br /> Page 2 <br /> Options for Implementation <br /> There are two options to consider in order to allow time for the City to implement changes <br /> in the Official Controls: <br /> 1. Development Moratorium <br /> 2. Phasing Plan within the Land Use Plan for properties North of County Road <br /> 33. <br /> Development Moratorium <br /> In order to make a recommendation to the City Council regarding a development <br /> moratorium,the Commissions should discuss the following components: <br /> A. Length of the moratorium—Minnesota Statute 462.355, Sub. 4 allows for the <br /> adoption of an interim ordinance which may "regulate, restrict, or prohibit any use, <br /> development, or subdivision within the jurisdiction or a portion thereof for a period <br /> not to exceed one year from the date it is effective." Said interim ordinance may be <br /> extended for such periods not to exceed a total of eighteen months. <br /> B. Applications which would be affected by the adoption of an interim ordinance <br /> moratorium) <br /> C. Purpose for implementing the interim ordinance -During the discussion, staff heard <br /> concerns regarding natural resources inventory, implementation of subdivision <br /> ordinance changes to encourage greenway implementation,transportation review <br /> and planning, and new zoning ordinances relating to Old Town and Public Facilities <br /> districts. <br /> Phasing Plan <br /> During a conversation with the City Attorney,City Administrator, and Mayor, the Mayor <br /> identified the attached option for a phasing plan. The plan would provide,in tiers by <br /> sections, lands to become guided for 2 1 acre density in 1, 5, and 7 year increments. The <br /> tiers would start closest to County Road 33. <br /> An alternative phasing plan would be to allow all lands north of County Road 33 to become <br /> guided for 2 'h acre density in say, 2006. This would allow the City to complete its future <br /> study work in 2004 and 2005. <br /> December 9, 2003 Special Meeting <br /> At the special meeting, staff will present information regarding the available developable <br /> acreage north of County Road 33,the current lot inventory, and any other information <br /> requested by the members of the Commissions. The discussion will revolve around the <br /> points in this memo.
