Approve,by motion,the Conditional Use Permit (CUP) request for automobile sales in the C3 zoning <br /> district with the following conditions: <br /> 1. As a CUP is not a building permit, the applicant must apply for and receive approval of all <br /> required permits. <br /> 2. Address all comments from staff in the comment letter dated December 18, 2013, before the <br /> CUP is issued. <br /> 3. Address all staff comments regarding stormwater management, ensuring the project meets <br /> the latest requirements for treatment and retention. <br /> 4. Service and overhead shall be of a similar color to the precast concrete panels. <br /> 5. Cornerstone Auto agrees to maintain"170th Lane"until the road is extended to 170th Court <br /> in Natures Edge Business Park. <br /> 6. The property shall be platted,and recorded,prior to the release of the building permit. <br /> Background/Discussion <br /> The applicant is requesting CUP,preliminary plat,and final plat approval for an automobile dealership in <br /> the C-3 zoning district. <br /> The applicant proposes to construct a new KTA dealership at the southeast corner of the intersection of <br /> Highway 10 and 171 st Ave. As part of the project, a new city street, 170th Lane,will be constructed to <br /> provide access to the dealership and a future connection to Natures Edge Business Park in the south. <br /> There will be no access from Highway 10 or 171st Ave. <br /> Additionally, the Board of Adjustments approved a variance to accommodate the plat as designed. The <br /> variance was approved on January 14, 2014. <br /> Planning Commission <br /> The Planning Commission did not have any concerns with the applications and unanimously <br /> recommended approval of both the Preliminary Plat and the CUP. <br /> Public Hearing <br /> The applicant spoke during the public hearing. He expressed his concern about the costs associated with <br /> constructing the proposed 170x'Lane to a higher tonnage than his use requires. He understands that the <br /> road will connect to the Natures Edge Business Park to the south,which will include industrial traffic.
