Conditional Use Permit, Case No. CU 14-01 Action Requested Approve,by motion,the Preliminary Plat for Jabez 2nd Addition with the following conditions: 1. Access restriction shall be placed along Highway 10 and 1715`Avenue. 2. Development agreement shall be signed outlining costs and responsibilities to the satisfaction of the city attorney. 3. The subdivision drawings shall be submitted to the city in an electronic format (.dwg file) as required by city ordinance and land use application. Approve,by resolution,the Final Plat with the following conditions: 1. Access restriction shall be placed along Highway 10 and 171st Ave. 2. Development agreement shall be signed, outlining costs and responsibilities to the satisfaction of the city attorney. 3. A letter of credit or other security acceptable to the city shall be provided in the amount of 100% of the cost of public improvements. 4. Upon completion of all improvements and acceptance by the city,a warranty bond in the amount of 25% of the improvement costs shall be submitted to the city for a one-year period. 5. A Surface Water Management fee in the amount required by the city at the time of final plat shall be paid prior to releasing the plat for recording. ($1,287 per acre,2014 rate) 6. A Sealcoat Fee in the amount to be determined by the city engineer shall be paid to the city prior to releasing the plat for recording. 7. A Park Dedication Fee shall be paid for the one buildable lot at the rate applicable at the time the plat is released for recording. The current rate for commercial is $7,444 per acre. 8. All required wetland and grading permits must be obtained prior to commencing work on the site. 9. Grading and erosion control plan and development plan shall be submitted to and approved by the city engineer prior to the issuance of grading permits. 10. All grading shall be certified prior to the issuance of building permits. 11. A Water Availability Charge shall be paid prior to releasing the plat for recording. 12. Any item or condition found that indicates the site is likely to yield information important to prehistory or history shall be reported to the city immediately.
