Landmark Environmental LLC <br /> December 17,2013 <br /> Mr. Chris Leeseberg <br /> City of Elk River <br /> 13065 Oronoco Parkway <br /> Elk River,MN 55330 <br /> Re: Review for Tiller Corporation Via email <br /> Conditional Use Permit Amendment Request,November 2013 <br /> Dear Mr.Leeseberg: <br /> As requested,this letter presents a summary of Landmark Environmental,LLC's(Landmark)review of <br /> the request for Tiller Corporation Conditional Use Permit(CUP), CU 97-19 Amendment. This <br /> engineering review is provided for the information contained in the following documents provided by <br /> Tiller Corporation(Tiller)as the CUP Amendment applicant: <br /> • Tiller Corporation Application to Amend Conditional Use Permit(CUP),CU 97-19 Mineral <br /> Extraction and Hot-Mix Asphalt Plant,Elk River,MN,November 2013. <br /> • Engineering Plans,C1-C3, 2013 Permit Amendment <br /> • City ordinances for Mineral Excavation,Sec.42-52. <br /> A Site visit was conducted by Landmark on December 17,2013 to review the Site operations,Site <br /> conditions and surrounding areas in relation to the proposed mining plans. Mr.Mike Caron, <br /> representing the applicant,escorted Landmark and provided additional information during the Site visit. <br /> City ordinances for Mineral Excavation, Sec.42-52 were used as the technical standards for application <br /> documents. The specific technical standard of the ordinance is identified with the findings from the <br /> review indicated in bold print. A number of ordinance requirements relate to operational(not design) <br /> provisions and comments for these requirements are also provided. Ordinance requirements which were <br /> outside the main scope of site design were not evaluated. <br /> Sec.42-52.Application. <br /> Application for an extraction license,conditional use permit and/or zone change,as required by this <br /> division,shall be made in writing to the council in the form specified by the city administrator. The <br /> application is required to contain the following information: <br /> (1)The correct legal description of the land upon which extraction is proposed. <br /> (2)The name and address of the applicant and the owner of the land. <br /> (3)The names and addresses of all adjacent landowners within a 350-foot radius as obtained <br /> from the records of the county auditor. <br /> (4)The purpose of the proposed extraction. <br /> (5)The estimated time required to complete the proposed extraction and rehabilitation. <br /> (6)The names of the highways,streets or other public roadways within the city upon which the <br /> material shall be transported. <br /> The applicant responses for these items were not reviewed. <br /> (7) Specifications for the following using appropriate maps,photographs and surveys: <br /> 2042 W.9e Street Bloomington,Minnesota 55431 Phone:(952)887-9601 Fax:(952)887-9605 www.landmarkenv.com <br />
