Planning Commission Minutes Page 4 <br /> December 10,2013 <br /> Motion by Commissioner Eric Johnson and seconded by Commissioner Mike <br /> Keller to continue the request by BWB Holdings LLC and ERX Properties, <br /> LLC to the January 14,2014 Planning Commission meeting. Motion carried <br /> 4-0. <br /> 4.4 Request by Marilyn VanPatten for Preliminary Plat approval (Heritage <br /> Maples), Case No. P 13-03 — Public Hearing <br /> 4.5 Request by Marilyn VanPatten for Conditional Use Permit (Heritage <br /> Maples), Case No. CU I3-I 1 — Public Hearing <br /> The staff report was presented by Zack Carlton. Staff recommended approval of the <br /> preliminary plat and conditional use permit with the conditions listed in the report. <br /> Chair Anderson asked why the plan shows a temporary cul-de-sac on the frontage <br /> road. Mr. Carlton explained that a connection cannot be made until future <br /> development of the adjoining property occurs and it is not owned by the applicant. <br /> Chair Anderson opened the public hearing. <br /> Ms. VanPatten, applicant- stated she was present to answer questions. <br /> Commissioner Eric Johnson asked if the applicant was in agreement with the <br /> conditions recommended by staff. <br /> Ms. VanPatten stated that the engineer advised they will have to be creative in order <br /> to locate the retaining wall on the property and that the slope of the pond may need <br /> to be increased. She explained the difficulty in providing a landscape plan for the <br /> entire site,when only a portion of the site was being developed at this time. She <br /> noted that they will work with staff on an overall landscaping plan. Mr. Carlton <br /> explained that the landscaping does not need to be installed on the entire site now. <br /> Mr. Barnhart noted that having a complete plan helps applicants know what to <br /> expect when the remainder of the site is developed. <br /> Discussion followed regarding the landscape plan. It was noted that the landscape <br /> plan needs to be modified to work with the layout of the patio. <br /> Chair Anderson stated he supported the plan, as long as the final plans show the <br /> future layout. <br /> Motion by Commissioner Eric Johnson and seconded by Commissioner Mike <br /> Keller to recommend approval of the preliminary plat request by Marilyn <br /> VanPatten for Heritage Maples, Case No. P 13-03 with the following <br /> conditions: <br /> 1.Access restriction shall be placed along Highway 10. <br /> 2. Development agreement shall be signed outlining costs and responsibilities <br /> to the satisfaction of the City Attorney. <br />
