Memo/East Elk River Project <br />September 14, 1998 <br />Page 2 <br /> <br />interest of the city to ultimately complete the larger project and accordingly, <br />the smaller project would be viewed as the first phase of the larger project <br />with a second phase needing to be undertaken within 2-3 years. This <br />material provides information on how much trunk sewer and water and <br />storm sewer assessments can be collected. It should be noted that Cargill got <br />notice for this September 28th public hearing, but were excluded from the <br />draft assessment roll, as their property is in a land conservatory. Assuming <br />a final assessment roll is prepared and this project moves forward, they will <br />be included in the assessment roster. <br /> <br />The first step in the 429 assessment process is to order a feasibility study. <br />This action has been taken. The second step in the 429 process is to formally <br />receive the feasibility report by resolution and call for the public hearing on <br />the project. This action is scheduled to take place on September 14th and the <br />Council should see the attached material and resolution from the City <br />Engineer on this topic. The September 28th public hearing is the third step in <br />the 429 assessment process. Additional steps in the 429 process include: <br /> <br />A resolution ordering the improvement and preparation of plans and <br />specifications (to be done on September 28th?) <br /> <br />A resolution determining the costs to be assessed and ordering the <br />preparation of the assessment roll (on September 28th? or in October) <br /> <br />Holding an assessment hearing for the proposed project (November <br />23ra?) <br /> <br />A resolution adopting the final assessment roll (November 23rd?) <br /> <br />A resolution approving the plans and specifications and ordering the <br />advertisement for bids (November 23rd?) <br /> <br />The city has had two limited appraisals completed regarding the benefit for <br />trunk sewer and water being extended into East Elk River. Parts of both of <br />these 1996 and April 1998 reports from Patchin and Associates are attached. <br />These lowest value identified in each report is for industrial lands and is <br />$6,000 an acre. Staff is comfortable recommending that this amount be <br />applied to all land uses in the eastern area and recommends the $6,000 per <br />acre assessment amount. While this amount is substantially more than the <br />$3,800 amount we used out west, it is clearly an amount that can be defended <br />in court during assessment appeals. It is the intention of the staff that this <br />amount be used in future phases of the project (i.e., extension down to 165th <br />Avenue along Highway 10) with a modest inflation amount being added <br />annually. <br /> <br />\\elkriver\sys\shrdoc\council\easter2.doc <br /> <br /> <br />
